Povzetek

V magistrski nalogi smo predstavili teoretična izhodišča, pri čemer smo združili razmišljanja različnih avtorjev ter skušali ustvariti celotno sliko odgovornosti dela vzgojiteljev iz dveh različnih zornih kotov, tako pravnega kot tudi etičnega, ki v praksi delujeta skupaj. Vsak zaposleni odgovarja za svoje delo in dejanja na delovnem mestu. Kako pa ta odgovornost vpliva na delo zaposlenih, pa je odvisno od vsakega posameznika posebej. Vzgojitelji smo poklicno zavezani Kodeksu etičnega ravnanja v vrtcu, ki predstavlja moralno zavezujoč akt, ki ga zaposleni v vrtcu, njegove vrednote in načela, razumemo kot zbirko smernic za zgledno delo. V nadaljevanju smo opredelili pojem nadzorstvene dolžnosti in ga umestili v prakso. Podrobneje smo predstavili Pravilnik o varnosti otrok v vrtcu, ki ga mora imeti vsak vrtec. Prav tako pa smo izpostavili bistvene strategije za preprečevanje poškodb otrok v vrtcih. Pri tem smo se sklicevali na Pravilnik o minimalnih tehničnih pogojih za prostor in opremo vrtca, Pravilnik o varnosti otrok v vrtcu, Standarde otroških igrišč ter si ogledali otroška igrišča in odgovornost vzgojiteljev z vidika zakonodaje. Ob vsem tem pa smo skušali vplesti vlogo vzgojitelja, ki prevzema ne samo eno vlogo, ampak več vlog hkrati, hkrati pa mora opravljati svoje delo pošteno, vestno ter odgovarjati za kršitve dolžnosti. V drugem delu predstavljamo izide empirične raziskave iz pomurskih vrtcev o: vzrokih, pogostosti, kraju in vrsti poškodb otrok, prav tako so nas zanimali podatki o počutju zaposlenih ob poškodbi otroka, stopnji potrebnega nadzora glede na starost otrok, podatki o opuščanju dejavnosti, izvedbi varnostnih ukrepov in zaščiti pred odgovornostjo, omejenosti sposobnosti dela, najpogostejših sankcijah, pogostosti in vzrokih za tožbe s strani staršev. Namen raziskave je: - preučiti odgovornost vzgojiteljev pri izvajanju nadzorstvene dolžnosti, - poiskati vzroke, ki privedejo do poškodb v vrtcih, - preučiti ukrepe vzgojiteljev, s katerimi poskrbijo za varnost otrok. Pri tem so nas zanimale razlike glede na delovno dobo vzgojiteljev.

Sekundarni povzetek: In this master's thesis we present the theoretical starting points, where we combined the thoughts of various authors and compare them to create a holistic view of the responsibility of kindergarten teachers from two perspectives: the legal and the ethical point of view, which are interwoven in practice. Each kindergarten teacher is responsible for their own work and actions while on at work. How this responsibility effects the work of the kindergarten teachers depends on individual cases. The kindergarten teachers are bind to the Codecs of ethical behavior in kindergarten, which is a morally binding act. The employees at a kindergarten understand its values and principles as the collection of guidelines on how to perform their work. Next we define the terms of the duties of child care and placed it into practice. We present the rules on Safety of children at kindergarten, which each kindergarten is obliged to have. We also stress the main strategies for injury prevention among children in kindergartens. As the basis for this we used the Regulations on minimal technical conditions for the facility and equipment of kindergartens, Standards of children playgrounds and we also examined the playgrounds and the responsibility of kindergarten teachers from the legal standpoint. At the same time we also tried to incorporate the role of the kindergarten teachers into our examination, as they must take responsibility for the roles they undertake, while doing their work honestly, thoughtfully and with legal responsibility if any breach of duty occurs. The second part of the paper presents the results of empirical research conducted in kindergartens in the statistic region of Pomurje, by examining injuries through following data: reasons, frequency, place and type of injury of a child. At the same time we also examined the feelings among staff when injuries occurred, needed level of care given depending on children%s age, data on careless work, implementation of safety measures and protection from responsibility, limited capacity to work, most common sanctions, frequency and reasons for law suits by parents. The purpose of the research was to: - study the kindergarten teachers' responsibility while performing their duties, - searching for reasons causing injuries in kindergartens, - studying the measures taken to ensure the safety of children. We gave special focus on differences connected to the length of working experience by kindergarten teachers.
