Povzetek
Diplomsko delo obravnava aplikacije enega izmed temeljnih stvarnopravnih načel – načela superficies solo cedit pri institutu gradnje na tujem zemljišču skozi razvoj, ki sega v čas rimskega prava, vse do današnje ureditve v Stvarnopravnem zakoniku .
Najprej so obravnavana teoretična izhodišča, nato pa sledi prikaz in uporaba načela skozi različna obdobja – od razvoja v rimskem pravu, do upoštevanja tega načela pri omenjenem institutu v različnih zakonskih virih, ki so se uporabljali na današnjem ozemlju Republike Slovenije.
Iz orisa rimskopravne ureditve naredimo velik preskok v leto 1811, ko je današnje ozemlje Republike Slovenije spadalo pod Habsburško monarhijo. V tem obdobju je veljal Obči državljanski zakonik – ODZ. Pri institutu gradnje na tujem svetu je ODZ sledil ureditvi iz obdobja rimskega prava in maksimo superficies solo cedit dosledno upošteval.
Po drugi svetovni vojni je na aplikacije načela superficies solo cedit v zakonskih določbah pomembno vplival institut družbene lastnine, saj na zemljiščih, ki so bila v družbeni lastnini ni bilo mogoče pridobiti lastninske pravice. V diplomskem delu so tako pojasnjene pravne posledice, ki so nastale v primeru gradnje zasebnika na družbeni lastnini.
Glede instituta gradnje na tujem zemljišču se je ODZ na našem ozemlju uporabljal do 1. septembra 1980, ko je pričel veljati Zakon o temeljnih lastninskopravnih razmerjih - ZTLR. V tem obdobju je omenjeno načelo pri gradnji na tujem zemljišču postalo izjema, saj je lastnik zemljišča zgolj izjemoma postal tudi lastnik objekta, ki ga je na njegovem zemljišču zgradil nekdo drug. V posameznih poglavjih so tako pojasnjene različne situacije gradnje na tujem svetu, pravne posledice, ki so iz teh situacij nastale, ter zahtevki, ki so jih stranke imele na voljo.
1. januarja 2003 je pričel vejati SPZ. Ta se je zopet vrnil k izročilu iz obdobja rimskega prava in uvrstil načelo superficies solo cedit med temeljna načela. Predstavljena so načela SPZ, ki jih je potrebno dosledno upoštevati pri institutu gradnje na tujem zemljišču, ter zakonske določbe, ki so s tem institutom vsaj posredno povezane. Dodani so tudi primeri iz sodne prakse z namenom, da se preizkusi, ali se de iure ureditev, na sodiščih tudi de facto uporablja.

This diploma discusses applications of one of the traditional principles of property law – the principle of superficies solo cedit in the institute of building on another’s land through its development in Roman law up to the current regulation in the Law of Property Code.
The theoretical frameworks are discussed in the beginning, followed by the applications of the principle in the mentioned institute in the various legal sources that have been used on the territory of today’s Republic of Slovenia.
The description of the principle of Roman law is followed by a big leap up to 1811, when the territory of Republic Slovenia was a part of the Habsburg Monarchy in which civil law was regulated by the Austrian Civil Code (ABGB). The ABGB was influenced by the Roman law, therefore it consistently followed the maxim superficies solo cedit in the institute of building on another’s land.
After the Second World War the principle of superficies solo cedit was affected by the institute of social property, as it was impossible for a private individual to obtain any ownership rights on land which was in social ownership. Therefore this diploma work discusses legal consequences that have occurred in the case that a private individual was building on social property.
The institute of building on another’s land was regulated by the ABGB until 1 September 1980, when the Law on Basic Property Relations came into effect. At that time the mentioned principle in the institute of building on another’s land became an exception, because it was only in exceptional cases that the owner of the land also became the owner of the building, built by someone else. In individual chapters various situations of building on another’s land are explained as well as the law consequences which had arisen and the legal requests which were available to clients.
On 1 January 2003 the Law of Property Code entered into force and returned to the classic principle developed back in Roman law and classified the principle of superficies solo cedit among the traditional principles. Traditional principles from the Law of Property Code relating to the building on another’s land are presented as well as legal provisions which are at least indirectly related to the noticed institute. |
