Povzetek
Diplomsko delo obravnava problematiko preiskovalnega novinarstva, ko le-ta preide na področje obveščevalne dejavnosti in dejavnosti preiskovalnih organov. Novinarstvo ima obveščevalno-varnostno službo, s policijsko preiskavo in postopki v predkazenskem in kazenskem postopku veliko skupnega. Preiskovalni novinar zbira informacije in javnosti razkriva dejstva, ki so nastala protizakonito in z nemoralnim delovanjem. Gre za dejstva, ki jih posamezniki, določene inštitucije ali politične elite želijo prikriti. Preiskovalno novinarstvo v ospredje postavlja interes javnosti in zato morajo biti teme, ki se jih loteva preiskovalni novinar, za družbo pomembne. Ravno zaradi teže pomena obravnavane teme se morajo preiskovalnih zgodb lotevati previdno, metode dela pa morajo biti v skladu z etičnimi novinarskimi načeli, navedenimi v Kodeksu novinarjev in v skladu s kazensko zakonodajo. Zaradi zahtevnosti zbiranja podatkov in nedostopnosti le-teh, se novinarji lotevajo tudi metod dela, ki niso v njihovi pristojnosti in so celo nezakonite. Kodeks novinarjev Slovenije opredeljuje novinarske metode dela, ki so etične in zavezane poklicu. Dokument ne sodi v pravno zakonodajo, kršitve le-tega tako niso podrejene kazenskim postopkom. Na odgovornost novinarjev in urednikov pa nakazujejo določbe v Kazenskem zakoniku, kjer so navedena kazniva dejanja v preiskovalnem novinarstvu. Ta se v večini navezujejo na zbiranje informacij (tako na tehnike zbiranja kot na izdajo tajnih podatkov) in pa na dejanja zoper čast in dobro ime. V Sloveniji smo se največkrat srečali s tožbenimi zahtevki, v katerih so kot razlogi navedeni razžalitev, žaljiva obdolžitev, obrekovanje, izdaja tajnih podatkov.

THE INTERVENTION OF INVESTIGATIVE JOURNALISM IN INTELLIGENCE ACTIVITIES AND MEASURES AGAINST THE MISUSE OF JOURNALISM AS A PROFESSION |

My thesis addresses the issues of investigative journalism operating in the jurisdiction of intelligence services and authorities. In essence, journalism does bare common characteristics with intelligence services, police enquiries and criminal law proceedings. The investigative journalist accumulates information and informs the public by means of presenting facts describing illegal or immoral activity - the very same facts which either individuals, certain institutions or political elite wish to conceal. Investigative journalism is rooted in public interest and therefore must be based on subjects relevant to the public community. Owing to the relevance of subject credibility, the journalist must employ careful investigative techniques, methods of scrutiny in accordance with ethical journalism principles as stated in the Journalist's Code within a valid criminal legislation. Due to demanding investigative circumstances or limited availability of data, the journalist will employ methods outside his/her authority or even illegal practices. The Slovenian Journalist's Code clearly states ethical investigative methods native to journalism however the document is not a part of legislation therefore any violation thereof is not prone to criminal proceedings. Furthermore, journalists do have responsibilities as stated in the penal code which also includes a list of criminal offences pertaining to investigative journalism. These offences commonly refer to collection of information (methods of acquiring and publishing of secret or reserved information) and acts against one’s reputation and goodwill. In Slovenia we have witnessed lawsuits triggered by claims of personal offence, offensive allegations, slander and issues of secret information. |
