Povzetek
Teroristični napad na Svetovni trgovinski center v New Yorku, 11. 9. 2001, ki so ga izvedli islamski teroristi, pomeni mejnik na področju boja proti terorizmu. ZDA so napovedale totalno vojno terorizmu. Začel se je lov na teroriste, predvsem na pripadnike Al Kaide, ki je dosegel svoj vrhunec najprej ob napadu na Afganistan in kasneje ob napadu na Irak. Pridržali so veliko oseb, za katere so sumili, da so povezani s terorizmom. Označili so jih kot nelegalne borce in jim niso priznali statusa vojnega ujetnika, kot to predvideva III. Ženevska konvencija o ravnanju z vojnimi ujetniki iz leta 1949. Na osnovi ukaza ameriškega predsednika Georga W. Busha, s katerim je CII dovolil uporabo vseh sredstev, da bi ujela Osamo bin Ladna in uničila Al Kaido, je CIA razvila poseben Program za pridržanje in zasliševanje. Z njegovo pomočjo naj bi od osumljencev pridobila podatke, ki bi ji pomagali uničiti teroristično mrežo Al Kaida. Osnova tega programa je bila t.i. »tehnika intenzivnega zasliševanja«. Prvič so program uporabili leta 2002 ob zajetju Abu Zubaydaha. Program je sprožil veliko dvomov tako s pravnega, humanitarnega kot strokovnega vidika, vendar je CIA ta način pridobivanja podatkov zagovarjala kot edino primernega, če želi pravočasno pridobiti podatke, ki so potrebni za uničenje Al Kaide.

World Trade Center terrorist attack in New York City on 9/11/2001, performed by the Islamic terrorists, represents a milestone on the field of the fight against the terrorism. The USA declared a total war against terrorism. They began hunting terrorists, mostly Al-Qaeda members, which reached its peak first with the attack on Afghanistan and later with the attack on Iraq. They detained a lot of persons, for who they suspected that they were linked to terrorism. They designated them as illegal fighters and they did not recognize them a prisoner-of-war status, as the 1949 Geneva Convention (III) relative to the Treatment of the Prisoners of War makes provision for. On the basis of the order of the American president George W. Bush, by which he allowed the usage of all the necessary means to the CIA to capture Osama bin Laden and destroy Al-Qaeda, CIA developed a special Detention and Interrogation Program. The latter should enable CIA to acquire the intelligence from the suspects that would help to destroy terrorist network of Al-Qaeda. The basis of this program was so called “enhanced interrogation technique”. The authors of the program were two external experts. For the first time it was used when capturing Abu Zubaydah. The program raised a lot of doubts form the legal, humanitarian and also professional perspective. The CIA, however, advocated such means of acquiring intelligence as the only suitable one, in order to acquire the intelligence, necessary to destroy Al-Qaeda, on time. |
