Povzetek
Namen diplomskega dela je predstaviti Zaposlovanje in odpuščanje invalidov. Invalidi predstavljajo posebno kategorijo delavcev, ki uživa posebno varstvo pred odpovedjo pogodbe o zaposlitvi.
Uvodoma so navedeni najpomembnejši mednarodni in nacionalni dokumenti, ki urejajo vprašanje zaposlovanja in odpuščanja invalidov.
V nadaljevanju so opisane osnovne značilnosti pogodbe o zaposlitvi.
Večja pozornost je namenjena poglavju o zaposlovanju invalidov, kjer so pojasnjeni osnovni pojmi invalid/delovni invalid, postopek pridobitve statusa invalida, oblike zaposlitve invalidov ter kvotni sistem zaposlovanja invalidov.
Na kratko je predstavljeno prenehanje pogodbe o zaposlitvi.
Sledi poglavje o odpovedi pogodbe o zaposlitvi, kjer je predstavljen postopek odpovedi pogodbe o zaposlitvi s ponudbo nove pogodbe o zaposlitvi in postopek odpovedi pogodbe o zaposlitvi brez ponudbe nove pogodbe o zaposlitvi.
Delodajalec lahko invalidu odpove pogodbo o zaposlitvi brez ponudbe nove pogodbe o zaposlitvi le, če so podani resni in utemeljeni razlogi za odpoved pogodbe, katerih utemeljenost pa mora ugotoviti Komisija.
V zadnjem delu sledi prikaz pravne ureditve položaja invalidov v Avstriji.

The purpose of diploma paper is to present employment and dismissal of people with disabilities. People with disabilities represent a special category of workers who are entitled to special protection against the termination of employment contract.
The introductory part presents the most important international and national documents regulating the question of employment and dismissal of people with disabilities.
The following part describes the key features of employment contract.
Greater emphasis is placed on the chapter of employment of people with disabilities, where the following basic terms are explained: person with disabilities/disabled worker, the procedure of acquiring disability status, the forms of employment for people with disabilities, and the quota system of employment for people with disabilities.
The conclusion of employment contract is briefly presented.
The next chapter describes the termination of employment contract as well as the termination procedure of employment contract with offer of a new employment contract and the termination procedure of the employment contract without offering a new contract of employment.
The employer can terminate the employment contract without offering a new contract to a person with disabilities only on the basis of serious and well-grounded reasons. The Commission establishes whether the reasons for the termination of contract are valid or not.
The last part presents the legislation regarding the position of people with disabilities in Austria. |
