Abstract
Ena izmed osnovnih življenjskih potreb je zagotovitev bivalnega prostora. Glede na finančne zmožnosti, želje in potrebe je vsakemu dana možnost, da se odloči na kakšen način bo stanovanjski problem rešil. Nepremičninski trg ponuja pestro izbiro in danes veliko populacije živi v stanovanjskih blokih oziroma v stavbah z dvema ali več stanovanji. V primeru, da stanovanjska stavba izpolnjuje pogoje za nastanek etažne lastnine v skladu z zakonom, se na posebnih in skupnih delih stavbe oblikujejo različna lastninska razmerja. Etažna lastnina je lastnina na posameznem delu zgradbe in solastnina na skupnih delih. To pomeni, da ima vsak lastnik posameznega dela določene obveznosti in pravice tudi na skupnih delih. Ker lastninska pravica na posameznem delu ne prinaša nekih bistvenih omejitev, sem se odločila, da v tej diplomski nalogi skušam prikazati posledice solastnine etažnih lastnikov na skupnih delih, predvsem kakšne pravice, obveznosti in možnosti so solastnikom dane v naši pravni ureditvi.

One of the basic human needs is to ensure its living space. Everyone has an opportunity to decide how and where he will live, taking into consideration ones financial capability, needs and wishes. Real estate market offers a lot of choices. Nowdays, a large proportion of the population lives in apartment buildings or in buildings with one or two apartments. If an apartment building fulfills the requirements that are needed for joint ownership due to the existing legislation, different ownership relationships appear on separate and common parts of the building. In a separate floor, ownership of a separate part and joint ownership of common parts of that floor brings responsibilities on common parts for each of the owners of the separate part. Ownership of a separate part does not limit the owner in any significant way. Therefore, I decided to present the Slovenian legal regulation of rights, obligations and options that joint owners have on common parts of the floor. |
