Abstract

Diplomsko delo prikazuje pravno ureditev lobiranja v Sloveniji in Evropski uniji. Lobiranje je pomembna dejavnost, ob primerni pravni regulaciji predstavlja širši vidik demokracije v interesu javnosti. Lobiranje v Sloveniji ni enotno urejeno, temveč parcialno v različnih zakonih in podzakonskih aktih, ki nimajo namena urejati tega področja neposredno, temveč ga urejajo posredno. Tako je urejeno v mednarodno pravnih aktih, Ustavi Republike Slovenije, delno v zakonih, v Poslovniku Državnega zbora in Državnega sveta. Urejeno je tudi preko pravilnikov in kodeksov, ki jih izdajajo lobistična združenja. Lobiranje v Evropski uniji ni urejeno z zakonodajo. Ker je Bruselj postal pomembno lobistično središče, se poskuša pridobiti pregled nad lobisti. Evropska komisija je uvedla register zastopnikov interesov, ki omogoča prostovoljen vpis. Evropski parlament za lobiste, ki želijo vstopati v prostore parlamenta, zahteva vpis v register lobistov, na podlagi katerega se izda izkaznica, ki jim to omogoča. V diplomskem delu je prikazana tudi primerjava ameriškega in evropskega pristopa k ureditvi lobiranja. Na koncu delo prikazuje konkreten primer lobiranja nevladne organizacije Amnesty International Slovenije proti uvedbi paralizatorja v slovensko policijo.

Secondary abstract: The thesis presents the regulation of lobbying in Slovenia and the European Union. Lobbying is an important activity, with approprite legal regulation it represents the expanding aspect of democracy in the public interest. Lobbying in Slovenia is not uniformly regulated but partially in various laws and regulatory acts that are not supposed to regulate this field directly, therefore they regulate it indirectly. This way it is regulated by International legal acts, the Constitution of the Republik of Slovenia, partially by laws, by Rules of Procedure of the National Parliament and National Council. It is also regulated through the regulations and codes issued by the lobbying associations. Lobbying in the European Union is not regulated by law. Since Brussels has become an important lobbying centre, it is trying to gain an overview of the lobbyists. The European Commission has introduced a register of representatives' interests which allows a voluntary registration. The European Parliament requires from the lobbyist, who would like to enter the premises of the Parliament, to sign in the register and on this basis a card is issued which allows them to do so. The thesis also shows a comparison between the American and European approach for the regulation of lobbying. At the end, the thesis presents a concrete example of lobbying of the non-governmental organization Amnesty International Slovenia agains the introduction of paralyzator in the Slovenian police.
