Abstract

Namen diplomskega dela je predstavitev odpovedi pogodbe o zaposlitvi delodajalca delavcu - invalidu. Gre za posebno kategorijo delavcev, kateri je zagotovljeno dodatno pravno varstvo pred odpovedjo pogodbe o zaposlitvi. Ureditev odpovedi pogodbe o zaposlitvi invalidom v slovenskem pravnem redu je nastajala v luči mednarodnopravne ureditve in je tako skladna z Evropsko socialno listino, Konvencijo MOD št. 159 o poklicni rehabilitaciji in zaposlovanju invalidov in Priporočilom št. 168 k tej konvenciji ter Konvencijo OZN o pravicah invalidov. Slovenska delovnopravna zakonodaja predvideva dodatno pravno varstvo pred odpovedjo pogodbe o zaposlitvi invalidov, ko gre za odpoved iz poslovnega razloga ali odpoved iz razloga nezmožnosti za opravljanje dela pod pogoji iz pogodbe o zaposlitvi zaradi invalidnosti. V slovenski pravni ureditvi torej ne velja absolutno varstvo pred odpovedjo pogodbe o zaposlitvi invalidov. Sama invalidnost pa je določena kot abolutno neutemeljen odpovedni razlog. Delodajalec lahko invalidu odpove pogodbo o zaposlitvi brez ponudbe nove pogodbe o zaposlitvi za nedoločen čas le v primeru, če invalidu iz utemeljenih razlogov ne more zagotoviti pravice do premestitve na drugo delovno mesto, ustrezno njegovi preostali delovni zmožnosti, poklicne rehabilitacije oziroma opravljanja dela s krajšim delovnim časom od polnega. Za ugotovitev razlogov za odpoved pogodbe o zaposlitvi invalidu pri delodajalcu, ki ima zaposlenih najmanj pet delavcev, je pristojna posebna Komisija za ugotovitev podlage za odpoved pogodbe o zaposlitvi. Primerjalnopravno gledano sta si slovenski in hrvaški pravni red glede odpovedi pogodbe o zaposlitvi invalidov v osnovi podobna, s posameznimi izjemami.

Secondary abstract: Purpose of my diploma thesis is to present the process of termination of employment contract to a disabled person. A disabled person belongs to a special catgory of workers, who have additional legal protection against dismissal provided. Regime for termination of employment for people with disabilities in the Slovenian legal order was created with a support of the international legal regime and is therefore compatible with the European Social Charter, ILO Convention no. 159 (Vocational Rehabilitation and Employment of Disabled Persons) and the Recommendation No. 168 to this Convention and the UN Convention on the Rights of Persons with Disabilities. Slovenian employment law provides additional legal protection against dismissal of a disabled person when a cancellation occurs because of a business reason or because of the disabled worker's inability to peform work under the terms of the contract of employment. The Slovenian legal system is therefore not a subject of an absolute protection against dismissal of a disabled person. Disability itself is defined as absolutely unfounded cause of dismissal. An employer may terminate the employment contract without offering a new employment contract for an endefinite period of time only if he cannot guarantee the transfer to another position corresponding to its residual capacity for work, vocational rehabilitation, or the provision of part-time work. If an employer has five or less employees, a special Commission is competent to find facts for the termination of the employment contract to a disabled person. In comparative terms, the Slovenian and Croatian legal order of termination of employment of disabled workers has similar basis with some exceptions.
