Abstract
V glavnem mestu so sedeži državnih organov in organizacij, tujih diplomatskih predstavništev, konzulatov in mednarodnih organizacij, zato je glavno mesto, kot eden izmed atributov državnosti, za vsako državo posebnega pomena. Lokalna skupnost, ki je nosilka položaja glavnega mesta, je tako postavljena pred dodatne zahteve in naloge, ki jih druge lokalne skupnosti ne poznajo oziroma se z njimi srečujejo v manjši meri. Zato ima glavno mesto znotraj sistema lokalne samouprave določen poseben položaj.
V Sloveniji daje poseben status glavnemu mestu že Ustava Republike Slovenije, konkretneje pa je odnos med državo in Mestno občino Ljubljana, kot glavnim mestom Republike Slovenije urejen v Zakonu o glavnem mestu Republike Slovenije, sprejetim leta 2004.
Ker je nosilka položaja glavnega mesta določena lokalna skupnost, zanjo veljajo tudi predpisi, ki se nanašajo na lokalno samoupravo, predvsem Zakon o lokalni samoupravi, Zakon o financiranju občin in Zakon o lokalnih volitvah.
Mestu Zagreb zagotavlja poseben status že Ustava Republike Hrvaške v 13. členu, konkretneje pa je odnos med državo in Mestom Zagreb kot glavnim mestom Republike Hrvaške urejen z Zakonom o Mestu Zagreb (»Zakon o Gradu Zagrebu«). Vsa vprašanja, ki se nanašajo na Mesto Zagreb, kot enoto lokalne samouprave, ki ima hkrati tudi položaj enote regionalne samouprave in jih ta zakon ne ureja, so urejena v Zakonu o lokalni in področni (regionalni) samoupravi.

In the capital city are headquarters of state authorities and organizations, foreign embassies, consulates and international organizations, therefore it presents one of the attributes of nationality and has a special meaning for every country. Consequently, a local community where the capital city is placed faces additional demands and tasks, which other local communities do not know or face to a lesser extent. So, the capital city has a special status within the system of local self-government.
In Slovenia a special status of the capital city is assigned already in the Constitution of the Republic of Slovenia, but a relationship between the state and the municipality of Ljubljana is concretely defined in the Capital City of the Republic of Slovenia Act, which passed in 2004.
Due to a fact that a status of the capital city is held by a certain local community, it has to fulfil also regulations regarding local self-government, above all the Local Self-Government Act, the Financing of Municipalities Act and the Local Elections Act.
A special status of the city of Zagreb is assured already in the Article 13 of the Constitution of the Republic of Croatia, while a relationship between the state and the city of Zagreb as the capital of the Republic of Croatia is more precisely regulated by the City of Zagreb Act. All issues regarding the city of Zagreb as a unit of local self-government, which at the same time also has a status of a regional self-government unit are regulated by the Local and Regional Self-Government Act. |
