Abstract

Z globalizacijo, vse hitrejšim tempom življenja in s tem povezanim stresom, se na delovnih mestih vse več pojavljata pojava diskriminacija in mobbing. Pojava sta zelo podobna, vendar pa med njima obstajajo pomembne razlike. Diskriminacija je neupravičeno postavljanje drugega v slabši položaj glede na katero izmed osebnih okoliščin (spol, spolna usmerjenost, starost, rasa, vera ali prepričanje, invalidnost …). Da lahko govorimo, da je delavec diskriminiran, je dovolj, da se to zgodi enkrat, medtem ko mobbing pomeni dalj časa trajajoče trpinčenje (psihično, verbalno, fizično). Da lahko govorimo o mobbingu, se mora neželeno ravnanje nad nekom izvajati najmanj 6 mesecev in najmanj enkrat tedensko. Vendar pa so posledice tako diskriminacije kot mobbinga podobne in se kažejo v slabši storilnosti delavca, vse pogostejši odsotnosti delavca z dela ter predvsem v psihičnih težavah delavca, osebni stiski. Na delovnopravnem področju je bilo glede prepovedi diskriminacije in mobbinga storjeno že veliko, zlasti z direktivami in usmeritvami Evropske unije, kot delovanjem mednarodnih organizacij (OZN, MOD, Svet Evrope) in ne nazadnje na nacionalni ravni z zakonodajo, nevladnimi in vladnimi organizacijami (Urad za enake možnosti, Varuh človekovih pravic) itd. Temeljne človekove pravice in svoboščine so ena izmed najpomembnejših vej, ki jih mora pravo nasploh zaščititi in se z vsemi možnimi sredstvi boriti proti vsem oblikam kršitev le-teh.

Secondary abstract: With globalization, the ever-increasing pace of life and related stress in the workplace is increasingly occurring phenomenon of discrimination and mobbing. Phenomena are very similar, but between them there are important differences. Discrimination is not justified in putting another disadvantage in relation to any of the personal circumstances (gender, sexual orientation, age, race, religion or belief, disability). We can say that the worker is discriminated against, it is enough that this happens once, while mobbing is a longer-lasting suffering (physically, verbally, physically). That we can talk about mobbing must be someone over unwanted behavior carried out at least 6 months and at least once a week. However, the effects of both discrimination and mobbing are similar and are reflected in lower productivity of the worker, a growing absence from work, and especially the worker's psychological problems and personal distress. In the field of labor was the prohibition of discrimination and mobbing done a lot, especially with the directives and guidelines of the European Union, as a function of international organizations and finally at the national level through legislation, non governmental and governmental organizations etc. Fundamental human rights and freedoms is one of the most important branches of the general law and protect by all means possible to fight against all forms of violation.
