Abstract

Avtorica v pričujočem diplomskem delu opredeljuje pojem delovnega razmerja in njegove elemente, ki so bistveni za ugotavljanje obstoja delovnega razmerja v praksi. Nadalje predstavlja rešitve, ki izhajajo iz Priporočila MOD št. 198 o delovnem razmerju in opisuje delovanje organov EU na delovnopravnem področju. V nadaljevanju obravnava razmejitev delovnega razmerja od ostalih oblik dela, s katerim je mogoče preprečiti poskuse prikrivanja delovnega razmerja. S slovensko sodno prakso prikazuje dokazovanje obstoja (elementov) delovnega razmerja. Prav tako pa opredeljuje pojem delovnega razmerja v nemškem pravnem sistemu in ga v ključnih točkah primerja s slovensko pravno ureditvijo.

Secondary abstract: In the following study the author defines the elements, essential for determining the existence of an employment relationship in practice. Solutions deriving from Recommendation ILO No. 198 regarding employment relationship are also presented as well as practice regarding labour law in EU. Below the author deals with the distinction between employment relationship and other forms of work that helps prevent the attempts to conceal the employment relationship. Following Slovenian law practice the author shows the demonstration of the elements of employment relationship. The notion of employment relationship in German law system is also defined and in key point compared to Slovenian regulation.
