Abstract

Vsaka država ima svojo nacionalno pravno ureditev, ki omogoča kupcem uveljavljanje pravic v primerih, ko pride s prodajalci do konfliktov zaradi napak, ki jih ima kupljeno blago (lahko tudi storitev). Kupec ima v primeru, da na kupljenem blagu najde stvarno napako, pravico zahtevati, da mu prodajalec blago pregleda in popravi ali zamenja. Zelo pomembno je, da je kupcu znano, po kateri zakonodajni določbi ima največ pravic in katera ga ščiti. O napaki na blagu mora kupec prodajalca obvestiti v določenem času, ki se po določbah različnih pravnih virov razlikuje, sicer s pretekom roka izgubi svojo pravico. Kupci so lahko fizične ali pravne osebe, ki imajo različne lastnosti, značaj in potrebe. Izdelki in koristi, ki jih daje izdelek ali storitev kupcu, se od kupca do kupca razlikujejo. Slovenija ima domačo in mednarodno pravno ureditev, ki sta v nekaterih ureditvah podobni, spet v drugih pa se razlikujeta. Kupci, ki so fizične osebe ali tako imenovani potrošniki (drugi odstavek 1. člena Zakona o varstvu potrošnikov (v nadaljevanju ZVPot), lahko svoje pravice uveljavljajo po določbi ZVPot, medtem ko lahko kupec, ki je pravna oseba, uveljavlja svoje pravice iz naslova stvarnih napak po Obligacijskem zakoniku. V slovenski sodni praksi se je Dunajska konvencija v obdobju zadnjih pet let (2012-2017) uporabila štirinajstkrat.

Secondary abstract: Each country has its own national legal rules, which allow customers to enforce their rights in cases where exist a conflict with sellers because of the errors that the purchased goods (or services) have. The buyer has the right to demand special examination, reparation or replacment from seller in case of a factual defect on bought goods. It is in great interest for buyer to be aware of legislative provision which protects him and provides him with the most rights. It is buyer’s responsibility to inform the seller about the error on bought goods within specific time, which varies between different legal sources, otherwise he loses his rights with the expiry of the deadline. Buyers can be natural or legal persons with different characteristics, character and needs. Products and benefits offered by the product or service to the customer who bought them, vary from customer to customer. Slovenia, therefore, has domestic and international legal arrangements, which are similar in some aspects, but different in others. Consumer, who is a natural person, has the most rights under the Consumer Protection Law, meanwhile legal persons have the most rights under the Code of Obligations. In Slovenian case-law, Vienna Convention has been used fourteen times in the last five years.
