Abstract
Človekove pravice so pravice, ki jih ima vsak posameznik v družbi. Policisti jih morajo pri opravljanju dolžnosti še posebej spoštovati in so v primeru njihove kršitve kazensko odgovorni. V Zakonu o nalogah in pooblastilih policije ter v Zakonu o kazenskem postopku so določena pooblastila, ki policistom dovoljujejo opravljati svoje naloge tudi v najspornejših situacijah.
Stanovanje je prostor, v katerem posameznik upravičeno pričakuje zasebnost, zato so razlogi za vstop policistov vanj zelo natančno opredeljeni. Cilj diplomske naloge je s pomočjo literature proučiti in podrobno opisati vse razloge, ki so potrebni za vstop v tuje stanovanje. Izpostavljeni so tudi problemi, ki se ob tem pojavijo. V nadaljevanju je narejena primerjava, kako je vstop v tuje stanovanje opredeljen v Zakonu o kazenskem postopku ter kako v Zakonu o nalogah in pooblastilih policije. V osrednjem delu so izpostavljeni in opisani razlogi za vstop v tuje stanovanje ter pogoji za izvedbo procesnih dejanj. Zadnji del diplomske naloge je namenjen primerom, ki opredeljujejo različne razloge za vstop v tuje stanovanje ter pojasnjujejo, ali je pri njih prišlo do kršitve človekovih pravic in zakaj.
V diplomski nalogi so prikazane glavne razlike med Zakonom o kazenskem postopku ter Zakonom o nalogah in pooblastilih policije. Predstavljeni so tudi pogoji za vstop v tuje stanovanje in hišna preiskava kot procesno pooblastilo policistov.

Human rights are rights that belong to all individuals. Police officers have to pay particular attention to human rights while they are on duty as they are subject to criminal liability if they violate them. The Police Tasks and Powers Act and the Criminal Procedure Act regulate the powers that allow police officers to carry out their tasks even in the most critical situations.
People rightfully expect to have privacy in their homes, therefore the justifications for police entry are determined in detail. The purpose of the thesis is to analyse the available written material and describe all the justifications for police entry into a home. The thesis analyses also the problems linked to it. The following chapters include a comparison between police entry as determined by the Criminal Procedure Act and police entry as determined by the Police Tasks and Powers Act. The central part of the thesis includes the study and the description of the justifications for police entry into a home, as well as the conditions for carrying out the relevant procedures. The final part of the thesis focuses on case studies which analyse different justifications for police entry into a home and determine whether there was a violation of human rights in the specific cases, as well as the reason for it.
The thesis presents the main differences between the Criminal Procedure Act and the Police Tasks and Powers Act. The thesis analyses also the conditions for police entry into a home, as well as police house search as a procedural power. |
