Sekundarni povzetek: | The Constitution of the Republic of Slovenia and other legal acts protect people from illegal infringement of human rights and fundamental freedoms. The powers stated in the Criminal Procedure Act and the Police Tasks and Powers Act allow the police to perform tasks even in the most complex and controversial circumstances. This paper studies entry into another person's apartment and other spaces and house search without a court order. The first part describes police powers as interference with fundamental human rights and freedoms and determines constitutionally protected rights to privacy and the right to inviolability of the home, derived therefrom. The second part of the paper details and analyses the conditions for entry into another person's apartment and other spaces and house search without a court order. The paper explains the problem of defining an apartment and other spaces and the related problem of conducting a house search with apartment owner's consent. It also addresses the problem of entering another person's apartment and other spaces and conducting a house search without a court order due to a violation and apprehension of a person following the order of a competent authority. For the purpose of illustration and easier understanding, differences between entry into another person's apartment and house search without a court order are determined. The third part of the paper analyses two court rulings of the Supreme Court of the Republic of Slovenia, trying to determine possible violations of the law. In the end, legal problems and dilemmas along with their solutions are presented. |
