Povzetek

Ustava Republike Slovenije v svojem besedilu zajema in ureja najpomembnejša področja družbenega življenja. Zasebnost posameznika je izredno pomembna, posameznik pa najvišjo stopnjo zasebnosti pričakuje v svojem domu. V stanovanju, v katerem bivamo, ljudje pričakujemo popolno zasebnost, zato smo tam tudi najbolj ranljivi. Posameznik v svojem domu živi v svoji intimni in zasebni sferi, ki je ne rabi deliti z nikomer oziroma se sam odloča, s kom in v kolikšni meri jo bo delil z drugimi ljudmi. Nedotakljivost stanovanja je izrednega pomena iz razloga varovanja človekove zasebnosti. V takšnem pomenu je bila nedotakljivost stanovanja prepoznana kot najstarejša oblika varstva zasebnosti človeka. Iz tega razloga tudi pravni sistem Slovenije določa, da je stanovanje prav vsakega posameznika nedotakljivo. Tako vsebuje tudi Ustava Republike Slovenije zagotovilo pravico do nedotakljivosti v 36. členu. Kdorkoli lahko poseže v ustavno zavarovano pravico, zato se morajo tisti posegi, ki so smatrani kot kršitve nedotakljivosti stanovanja, kazensko preganjati. Kljub temu da je nedotakljivost stanovanja ustavno zaščitena dobrina, Ustava Republike Slovenije dopušča posege v to pravico. Relativnost pravice do stanovanjske nedotakljivosti je dopuščena z ustavno dovoljenim vstopom v tuje stanovanje in celo njegovo preiskavo, vendar pod pogoji, ki so določeni z zakonom. Iz tega razloga pravico do nedotakljivosti stanovanja ogroža izvršilna veja oblasti. Uradne osebe, ki opravljajo vstope in preiskave tujih stanovanj, morajo slediti zakonskim določilom in spoštovati določena pravila, zato morajo imeti znanje in biti ustrezno usposobljeni. Kršitve največjega upravnega organa v državi na tem področju so številne, zato je potreben nadzor nad poseganjem v stanovanjsko nedotakljivost, ki pa ga izvaja sodna veja oblasti.

Sekundarni povzetek: In its text, the Constitution of the Republic of Slovenia covers and regulates the most important areas of society. An individual%s privacy is extremely important, and where does an individual expect the highest level of privacy? In his or her home. In the dwelling where the person lives, he or she expects complete privacy and that is why we are also the most vulnerable there. In his or her home, the individual lives in his or her intimate and private sphere, which they don%t need to share with anyone. Alternatively, they can decide with whom and to what extent they can share it with other people. The inviolability of the home is of paramount importance for the protection of human privacy. In this sense, the inviolability of the home has been recognized as the oldest form of protection of human privacy. For this reason, the legal system of Slovenia also stipulates that the apartment of every individual is inviolable. Thus, the Constitution of the Republic of Slovenia also guarantees the right to inviolability in Article 36. Anyone who interferes with this constitutionally protected right, is breaking the law and such interventions are considered violations of the inviolability of the home, and therefore must be prosecuted. Despite the fact that the inviolability of the home is a constitutionally protected right, the Constitution allows some encroachments on this right. The relativity of the right to inviolability of the home is permitted in some cases, such as entry into a foreign apartment and even the investigation thereof, but only under conditions determined by law. For this reason, the right to the inviolability of the home is threatened by the executive branch. Officials conducting entries and searches of foreign homes must follow the legal provisions and comply with certain rules, and in addition, they must possess legal knowledge and be properly trained. Violations of the largest administrative body in the country are numerous and therefore it is necessary to control the interference with the inviolability of housing carried out by the judiciary.
