Abstract

V prvem delu diplomske naloge je podrobno opisan sam princip delovanja in temeljni podatki o poslovnem modelu Uber. V povezavi z njim je obrazložen tudi pojem sodelovalne ekonomije, ekonomije na poziv in podobnih pojmov, ki najlepše obrazložijo, kakšen je princip delovanja tovrstnih platform, ki za svoje poslovanje izkoriščajo prednosti, ki jih prinaša razvoj mobilnih aplikacij in pametnih telefonov. V povezavi s tem je opisana tudi problematika, ki jo obstoj tovrstnih platform nujno prinaša. V drugem delu so podrobno obrazloženi pojmi, ki se pojavljajo v zvezi z delovnopravnim statusom vseh zaposlenih. To so zlasti pojem delavca, samozaposlene osebe ter ekonomsko odvisne osebe. Ker naloga med drugim temelji na primerjavi angleške in slovenske delovnopravne zakonodaje, so v tem delu pojasnjene tudi razlike med pojmom delavca v smislu ZDR-1 in pojmoma »worker« in »employee«, ki ju navaja angleški »Employment Right act« ter razmerje med njima. Pravni položaj voznikov Uberja je opredeljen na podlagi ene najodmevnejših sodb Mr Y Aslam, Mr J Farrar and Others V Uber, ki predstavlja temelj diplomske naloge in eno izmed ključnih podlag za določitev delovnega statusa Uberjevih voznikov. Med drugim naloga zajema tudi presojo, ali bi jim ob upoštevanju slovenskega Zakona o delovnih razmerjih lahko priznali status ekonomsko odvisnih oseb. Na koncu so na podlagi ugotovljenega opisana še predvidevanja, kakšen status bi vozniki Uberja imeli v primeru, da bi le-ta prišel v Slovenijo oz. kakšna rešitev bi bila v tem primeru najprimernejša.

Secondary title: The labor status of Uber drivers
Secondary abstract: The first part of the diploma thesis describes the principle of working and basic data about business model Uber. There are the terms of co-operative economics, market appeal, and similar terms, which describe the best of the platforms' operation principle. They use advantages for their business brought by the development of mobile applications and smart phones. Issues of such platforms are also described in connection with that. The second part describes the terms in details, which appear in connection with labour law status of all employees. These are especially the terms: a worker, a self-employed person, and an economically independent person. Among other things, the thesis is based on a comparison between English and Slovene labour law legislation, therefore, the differences between the term "worker" in the meaning of ZDR-1 and "worker" and "employee", which are explained by the English "Employment Right Act", and relationships between them are explained. The legal position of the Uber drivers is defined based on the most attention-grabbing verdicts Mr Y Aslam, Mr J Farrar, and Others V Uber, which is the basis of the diploma thesis and one of the key foundations for definition of labour status of Uber drivers. Among other things, the thesis includes the judgement if they could be acknowledged by the status of economically dependent persons according to the Slovenian Law of labour relations. There are expectations described at the end what the status of the drivers of Uber would be in case if it came to Slovenia and what solutions would be the most appropriate if it happened.
