Abstract

V magistrskem delu je predstavljen vpliv digitalizacije na posamezne vidike delovnega razmerja. Digitalizacija povečuje obseg dela, kar pomeni, da v določenih primerih delavcem ni zagotovljen minimalen počitek. Kljub temu, da delavci veliko dela opravijo izven delodajalčevih prostorov s pomočjo informacijske tehnologije, ni mogoče časa, ki ga delavci porabijo za to delo vedno obravnavati kot delovni čas, kajti v določenih primerih niso izpolnjeni vsi pogoji iz Direktive 2003/88/ES, ki ureja določene vidike organizacije delovnega časa. Digitalizacija ima vpliv tudi na varnost in zdravje delavcev. Danes so v porastu predvsem psihosocialna tveganja, med katerimi so nekatera že poznana, druga pa so povsem nova. Prepoznavanje psihosocialnih tveganj je težavno, ker gre za težko merljivo področje, ki je povezano predvsem s subjektivnim doživljanjem dela, zato je izjemno pomembno razviti orodja, ki bodo delodajalcem pomagala obvladovati ta tveganja. Z digitalizacijo je postal nadzor nad delavci za delodajalce lažji in bolj dostopen, vendar pa delodajalci nimajo pravice do popolnega nadzora nad delavci, saj delavci tudi na delovnem mestu utemeljeno pričakujejo določeno mero zasebnosti. Tehnološki razvoj je prinesel nove oblike kršitev obveznosti delavcev, ki so vezane predvsem na uporabo spleta.

Secondary abstract: Master's thesis deals with the influence of digitalisation on different aspects of employment relationship. Digitalisation increases the workload, which in some cases means that workers do not get a guaranteed minimum rest. In spite the fact that a lot of work is done outside the employer's premises through information technology, time spent for working is not always considered as working time. In some cases, not all conditions of Directive 2003/88/EC, which covers certain aspects of the organisation of working time, are fulfilled. Digitalisation also has an impact on safety and health at work. Psychosocial risks – some of them already known, some completely new – are on the rise. Recognizing them is difficult, because they are related to subjective experience of work, which makes them difficult to measure. Therefore, it is very important to develop tools, which will help employers manage these risks. Digitalisation has made it easier for employers to control employees, but employers do not have unlimited right to control employees, because employees justifiably expect some privacy at work. Technological development brought new types of breaches of employee's obligations, which are mostly related to the use of the internet.
