Abstract

Predstavljena je problematika zaposlovanja na podlagi pogodbe o zaposlitvi za določen čas, ki je dokaj pogost način, čeprav naj bi bil uporabljen le izjemoma. Prikazano je, kako je to področje zakonsko urejeno. Podanih je nekaj teoretskih osnov delovnega prava, opredeljeni so njegovi viri, podrobneje so opisane značilnosti pogodbe o zaposlitvi za nedoločen čas in pogodbe o zaposlitvi za določen čas. Analiza številnih primerov sodne prakse, nanašajočih se na zaposlovanje in delo za določen čas, razkriva, da sodišča nekatera še tako jasna zakonska določila tolmačijo drugače, kot je bilo predvideno, kar omogoča delodajalcem številne zlorabe, delavce pa pogosto postavi v neenakopraven položaj. Na podlagi analize odgovorov iz anketnega vprašalnika, namenjenega delavcem, zaposlenim na podlagi pogodbe o zaposlitvi za določen čas, ugotavljamo, da se delavci večinoma zavedajo kršitev zakonodaje, a raje ne ukrepajo, saj se bojijo za svoje službe. Zato je predlaganih nekaj konkretnih možnosti izboljšav delovnopravne zakonodaje, ki bi še bolj zaščitile delavce, delodajalcem pa še bolj omejile možnosti za morebitne zlorabe in nadaljnje kršitve.

Secondary title: The legal aspects of entering into a fixed term employment agreement
Secondary abstract: The intention of this diploma thesis is to present the challenges of hiring employees on the basis of a fixed-term employment contract, which is a fairly common method, although it should be used only exceptionally according to Slovenian labor law. We are capturing how this area is regulated by Slovenian labor law with presenting some theoretical foundations of the abovementioned law, defining sources of the law and presenting characteristics of a fixed-term employment contract and permanent employment contract in more detail. An analysis of several Labor Law Court cases relating to employment and hiring based on temporary employment contracts reveals that some of the clearly defined legal provisions are interpreted differently than anticipated, which makes it possible for employers to abundantly abuse employees’ rights and often place workers in an unequal position. Through the analysis of questionnaire answers that were provided by workers hired on the basis of a fixed-term employment contract, we conclude that workers are largely aware of the law violations however they refuse to take any action because of the fear of losing their jobs. Therefore, some concrete proposals for improving Slovenian labor law legislation are proposed, targeted to protect workers, while further limiting the possibilities of violations from employers’ side.
