Povzetek
V diplomskem delu je obravnavana delovnopravna tematika, in sicer instituti Zakona o delovnih razmerjih (ZDR-1), katerih temeljni namen je zagotoviti ustrezno stopnjo pravne varnosti delavcev ter drugih kategorij oseb, ki niso v delovnem razmerju, vendar jim zakon zagotavlja določeno delovnopravno varstvo.
V drugem poglavju zaradi lažjega razumevanja obravnavane problematike pojasnim nekatere temeljne pojme in načela delovnega prava kot sta delovno razmerje in pogodba o zaposlitvi. Ker je ZDR-1 razmeroma nov zakon, sem tretje poglavje namenil obravnavi razlogov, ki so privedli do sprejetja nove delovnopravne zakonodaje ter ugotovil, kako je na spremembe zakona vplivala zakonodaja Evropske unije. Pojasnil sem tudi namene in cilje, ki jih skuša zakon uresničiti ter predstavil nove rešitve, ki jih zakon določa. Četrto poglavje obravnava razmerje med ZDR-1 in kolektivnimi pogodbami. Opredelil sem nekatere temeljne pojme, kot so kolektivna pogodba in kolektivna pogajanja. V nadaljevanju sem se osredotočil na spremembe določb ZDR-1, s katerimi zakon vpliva na urejanje pravic delavcev v kolektivnih pogodbah, ter poskušal prikazati prednosti in slabosti sprememb glede na položaj delavcev.
Peto poglavje predstavlja jedro diplomskega dela, saj so v njem predstavljeni in pojasnjeni bistveni instituti zakona v smislu zagotovitve večje pravne varnosti delavcev. Posamezne institute sem obrazložil in podrobneje pojasnil zakonske določbe, ki glede na prejšnjo delovnopravno zakonodajo pomenijo spremembe v korist delavcev. Ob tem sem želel ugotoviti tudi morebitne pomanjkljivosti oz. slabosti zakonodaje glede na položaj delavcev. Šesto poglavje obravnava dve kategoriji oseb, ki opravljajo delo, vendar niso v delovnem razmerju. Ker je njihov položaj primerljiv položaju delavcev, jim ZDR-1 zagotavlja določeno stopnjo delovnopravnega varstva. V zaključku diplomskega dela je navedena sklepna ugotovitev glede obravnavane tematike, s katero sem podal odgovor na zastavljeno trditev, da ZDR-1 povečuje pravno varnost delavcev in drugih oseb.

The topic of the diploma paper is labour law, namely The Employment Relationship Act, whose fundamental purpose is to provide a suitable degree of legal security for the workers and other individuals who are not in an employment relationship – yet the law ensures them a certain degree of employment security.
Due to a better understanding of the discussed issues, the second chapter contains some basic definitions and principles of labour law such as an employment relationship and employment contract. As the ZDR-1 is a rather new Act, the third chapter deals with reasons that led to the adoption of the new labour legislation and how the EU legislation influenced the changes of The Employment Relationship Act. I have also explained the intentions and goals the Act tries to fulfil and presented new solutions that are defined in the Act. The fourth chapter deals with the relationship between ZDR-1 and collective agreements. I have defined some fundamental concepts such as a collective agreement and collective bargaining. Thereafter I have focused on how the provision changes (in the ZDR-1) affect the workers’ rights in the collective agreements – I have tried to present the advantages and weakness of these changes.
The fifth chapter is the core of the diploma paper. It contains a presentation and explanation of fundamental institutions of the Act, with a view to ensuring a higher degree of legal security for the workers. I have presented individual institutions and given a detailed explanation of legislative provisions, which, compared to the previous labour legislation, constitute a novelty and change in benefit of the workers. I have also tried to establish possible imperfections or weaknesses in the legislation – in relation to the situation of the workers. The sixth chapter deals with two categories of people who work, but are not in an employment relationship. As their status is comparable to the employed workers, the ZDR-1 assures them a certain degree of labour security. In the conclusion of my diploma paper, I have stated my finding on the discussed subject and given an answer to the claim that ZDR-1 increases the legal security of workers and other people. |
