Abstract
Civilni pravdni postopek temelji na različnih načelih. Načelo kontradiktornosti ali načelo obojestranskega zaslišanja strank je eno od najpomembnejših temeljnih načel civilnega pravdnega postopka. Načelo kontradiktornosti pride še posebej do izraza na glavni obravnavi, zato mora potekati tako, da je strankama zagotovljena možnost, da se izjavita. To pomeni, da ima stranka pravico, da navaja dejstva in predlaga dokaze ter da se izjavi o trditvah in navedbah nasprotne stranke. Pravica do izjavljanja strank se lahko uresniči le, če je stranki prej zagotovljeno, da bo izvedela za procesna dejanja, glede katerih ima pravico se izjaviti. Nujen pogoj za uveljavljanje pravice do izjave je pravica do informacije, ki jo zagotavlja procesni institut vročanja. V diplomski nalogi bom obravnavala najpomembnejše procesne institute, v katerih se uresničuje načelo kontradiktornosti, in sicer: pravica do informacije, jamstva v dokaznem postopku, pravica do izjavljanja in pravna vprašanja, učinek sodbe na osebo, ki v postopku ni bila stranka, obveznost do opredelitve sodišča do navedb strank, institut vrnitve v prejšnje stanje, pravica do izjavljanja glede vmesnih procesnih sklepov, pravica do izjave v postopku za izdajo začasne odredbe, prekluzije glede navajanja dejstev in novih dokazov. Pomembno je tudi, da se v pravdnem postopku zagotovi enakopravnost pravdnih strank. Obravnavala bom tudi izjeme od načela kontradiktornosti, ki sta v pravem pomenu besede le dve. Omejitev načela kontradiktornosti pa se nanaša na posebni postopek izdaje plačilnega naloga. Predstavim tudi kršitve načela kontradiktornosti, ki je absolutna bistvena kršitev postopka, osredotočila se bom na pritožbeni postopek in postopek z izrednimi pravnimi sredstvi.

Civil justice procedure is based on various principles. The principle of adversariality or the principle of mutual hearing between the parties is one of the most important basic principles of civil litigation. The principle of adversarialism is particularly expressed at the main hearing, and must therefore be conducted in such a way as to provide the parties with the opportunity to make their statements. This means that the client has the right to state the facts and to propose the evidence, and to make statements about the claims and statements of the counterparty. The right to make a statement can only be made if the party is previously assured to find out about the procedural acts in relation to which he has the right to make a statement. An essential requirement for exercising the right to a declaration is the right to information provided by the process institute of service. In the diploma paper we will discuss the most important procedural institutes in which the principle of contradiction is being implemented, namely, the right to information, guarantees in the evidentiary procedure, the right to be heard and legal issues, the effect of the judgment on a person who was not a party to the procedure, the obligation to define the court to the parties’ statements, the institute restitution, the right to make a declaration on interim procedural decisions, the right to be heard in the procedure for issuing an interim injuction, an objection to the giving of facts and new evidence. It is also important that in the civil proceedings the equality of litigants is guaranteed. It will also deal with exemptions from the principle of contradiction, which, as exceptions, are only two in the true sense of the word. The limitation of the principle of contradiction relates to a specific procedure for issuing a payment order. If there is a violation of the principle of adversariality, which is an absolute fundamental violation of the procedure, I will concentrate on the appeal procedure and the procedure with extraordinary legal remedies. |
