Abstract

Diplomsko delo predstavlja področje Ustanovne listine OZN, ki ureja varovanje mednarodnega miru in varnosti. Bistveni za to področje sta poglavji VI in VII Listine ZN. Organizacija združenih narodov je v Listini ZN vzpostavila sistem kolektivne varnosti, ki temelji na prepovedi uporabe sile. Kolektivna varnost je tudi osrednjega pomena za to diplomsko delo. Naloga se v prvem delu osredotoča na predstavitev osnov, ki so potrebne za razumevanje koncepta kolektivne varnosti, in sicer bom najprej predstavila Ustanovno listino OZN z zgodovinskega vidika in z vidika mednarodnega prava. Pomembno je tudi navesti cilje in načela OZN, na katerih gradi celotna Listina ZN in katere morajo OZN pri svojem delu ves čas upoštevati in iz njih izhajati. Nato sem se osredotočila na organe, ki so ključni na področju varovanja miru, predvsem sem tukaj hotela ugotoviti ali ima VS, kot primarni organ na področju varovanja miru, izključne pristojnosti ali pa imajo tudi drugi organi OZN kakšne dopolnilne pristojnosti in pooblastila na tem področju. Jedro naloge je v predstavitvi mirnih načinov reševanja sporov in izvršilnih ukrepov po sedmem poglavju Listine ZN. Na zadnje sta predstavljena še razorožitev in mirovne operacije OZN, ki ju lahko označimo za ena izmed osrednjih dejavnikov ohranjanja mednarodnega miru in varnosti. Mirovne operacije niso izrecno urejene v Listini ZN, vendar sem jih kljub temu predstavila zaradi njihovega pomena in ker jih nekateri dejansko uvrščajo med šesto in sedmo poglavje Listine ZN.

Secondary title: Peacekeeping under the Charter of the United Nations
Secondary abstract: The diploma thesis represents the field of the UN Charter, which regulates the protection of international peace and security. Essential for this field are chapters VI and VII of the UN Charter. In the UN Charter, the United Nations has established a system of collective security based on a ban on the use of force. Collective security is also central to this thesis. In the first part, thesis focuses on presenting the basics, necessary for understanding the concept of collective security. I will first present the UN Charter from a historical point of view and from the point of view of international law. It is also important to list the objectives and principles of the UN on which the entire UN Charter is built and which the UN must, at all times, take into account and derive from it. Then I was concentrated on the key authorities in the field of peacekeeping. In particular, here I wanted to find out whether the Security Council, as the primary body in the field of peacekeeping, has exclusive competence or other UN bodies also have some additional powers in this field. The core of the thesis is to present the peaceful ways of resolving disputes and enforcement measures under Chapter VII of the UN Charter. Finally, disarmament and UN peacekeeping operations are presented, which can be described as one of the key factors for maintaining international peace and security. Peacekeeping operations are not explicitly regulated in the UN Charter, but I nevertheless presented them because of their significance, and because some of them actually rank them among the sixth and seventh chapters of the UN Charter.
