Abstract
Diplomsko delo je zasnovano kot preglednica členov VII. poglavja Ustanovne listine Organizacije združenih narodov z njihovo analizo, ki vsebuje namen, uporabo in morebitne spornosti, ki iz njih izhajajo, vsak člen pa je tudi utemeljen s primeri uporabe iz zgodovine, ki so prikazali njegove prednosti in pomanjkljivosti.
Osrednje poglavje se prične z analizo 39. člena Ustanovne listine in pojmov ogrožanja miru, kršitev miru in dejanj agresije, katerih obstoj mora Varnostni svet Organizacije združenih narodov ugotoviti kot predpogoj za uporabo začasnih ukrepov, ukrepov brez uporabe sile in oboroženih ukrepov. Te tri vrste ukrepov so nato razdelane v okviru členov, iz katerih izhajajo. Pri podpoglavju, ki obravnava oborožene ukrepe sta obravnavana tudi koncepta delegiranja pristojnosti za izvajanje oboroženih ukrepov in mirovnih operacij s pristojnostmi po VII. poglavju, ki sta se razvila kot glavna načina za premostitev praznine, ki je nastala zaradi neformiranja stalne vojske Združenih narodov, kot je bila predvidena v poglavju. Na koncu je v okviru analize zadnjega, 51. člena VII. poglavja Ustanovne listine, obravnavana še pravica do samoobrambe in variacije, ki so iz nje izšle.

Secondary abstract: |
This thesis is designed as a review of the articles in Chapter VII of the Charter of the United Nations, containing analysis of their purpose, use and controversies. Attached to the analysis of every article are examples of their use which best illustrate their advantages and shortcomings.
The main part of the thesis begins with an analysis of the Article 39 of the Charter and the concepts of threats to the peace, breaches of the peace and acts of aggression, the existence of which the Security Council must determine as a precondition for the use of provisional measures, measures not involving the use of armed force and measures involving the use of force. These three types of measures are then analyzed within the Chapter VII articles from which they originate. The subsection of the thesis dedicated to measures involving the use of force also includes analysis of the concepts of the delegation of powers and peacekeeping missions operating under Chapter VII of the Charter, which were developed as the main means of overcoming the legal vacuum created by the failure to form a standing United Nations army as envisaged in the Charter. The last part of the thesis is dedicated to the analysis of the Article 51 of the Charter including the right of self-defence and all its variations. |
