Abstract

Magistrska naloga postavlja v ospredje izvršilni postopek, bolj natančno postopek zavarovanja. Eno od sredstev zavarovanja so tudi predhodne odredbe, ki bodo v nalogi podrobneje predstavljene. Predstavila bom postopek izdaje predhodne odredbe, pogoje za izdajo in vrste predhodnih odredb. Predhodne odredbe so ukrep sredstva zavarovanja, ki je učinkovito za upnike, saj z njimi zavarujejo svojo terjatev za primer nevarnosti, če bo uveljavitev njihove terjatve onemogočena ali otežena. Gre za sredstvo zavarovanja, ki se uveljavi na predlog upnika in je časovno omejeno. Namen ukrepov zavarovanja je, da se z njimi zagotovi možnost oprave prihodnje izvršbe, to je potem, ko že obstaja kvalificirana listina o obstoju denarne terjatve, ampak ta še ni izvršljiva . Predhodne odredbe ureja Zakon o izvršbi in zavarovanju (v nadaljevanju: ZIZ), ki je bil do zdaj že večkrat noveliran. Ampak za institut predhodnih odredb sta pomembni samo noveli I in J. Navedeni noveli pomenili spremembo glede domnevane nevarnosti, pristojnosti in vrste predhodnih odredb. Zadnja novela, to je L, pa je dodala še eno sodbo, na podlagi katere se domneva, da je podana nevarnost. Področje predhodnih odredb lahko navežemo tudi na področje stečaja. Novela Zakona o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju, to je novela F , je uredila vprašanje, kaj pomeni uvedba stečaja na področju zavarovanja. Določila je, da se z trenutkom uvedbe stečaja ustavi postopek s predhodno odredbo in se razveljavijo vsa dejanja, ki so bila opravljena v tem postopku.

Secondary title: The procedure for issuing the priliminary injunction with the analysis of the case law
Secondary abstract: The master's thesis puts the executive procedure at the forefront, precisely the procedure of insurance. One of the means of insurance is also preliminary injunctions, which will be detailed in the thesis. I will present the procedure for issuing the preliminary injunctions, the conditions for issuing and the types of preliminary injunctions. Preliminary injunctions are a measure of a means of insurance that is efficient for creditors, as they protect their claim against the risk of imposing their claim on hold or making it difficult. It is a means of insurance that is enforced on a creditor's proposal and is limited in time. Therefore, the purpose of the insurance measures is to provide them with the possibility of enforcing future enforcement, i.e. after a qualified instrument exists on the existence of a receivable, but it is still unenforceable. Furthermore, preliminary injunctions are governed by the Enforcement and Insurance Act (hereinafter: ZIZ), which has been amended on several occasions to date. Only the novelties I and J, however, are relevant to the institute of preliminary orders. As I mentioned before, novelties I and J have made a major change in the area of preliminary injunctions, namely the alleged danger, jurisdiction, and types of preliminary orders. The last novel, i.e. L, added another judgment on the basis of which the danger is assumed. The field of preliminary orders can also be included in the area of insolvency. The amendment to the Financial Operations Act, insolvency proceedings, and enforced termination, i.e. the novelty F, regulated the question of what the introduction of insolvency implies in the area of insurance. With the moment of the insolvency, the procedure with the previous order is stopped and all the actions that were taken during this procedure are annulled.
