Abstract

Prispevek obravnava avtorskopravno varstvo del konceptualne umetnosti in izpostavlja probleme, ki se pri tem pojavljajo. Osredotoča se predvsem na ureditev v Republiki Sloveniji, hkrati pa analizira tudi francosko sodno prakso in teorijo, kjer izpostavlja predvsem novejši pristop, ki je naklonjen razširitvi razlage zakonskih predpostavk in holistični oceni sodobnega umetniškega dela. Avtorica zaključuje, da lahko z ločevanjem med abstraktno idejo in idejo, ki se je na ustrezen način izrazila v zunanjem svetu, uporabimo subjektiven pristop k individualnosti tudi za konceptualna umetniška dela, ki jih lahko na ta način ustrezno avtorskopravno zavarujemo.

Secondary title: Copyright protection for a word?
Secondary abstract: The paper deals with protection of works of conceptual art by copyright and sets out the problems linked to such protection. It focuses primarily on the Slovenian legal system but analyses French theory and legal practice as well, where it focuses on its new approach, which is inclined to broaden legal requirements and focusing on holistic approach to a work of contemporary art. The authoress concludes that by separating between an abstract idea and an idea, which has been properly expressed, subjective approach to originality can be used also for conceptual works of art that can consequently become protected by copyright.
