Abstract
Mednarodno pravo je sistem pravnih pravil, ki urejajo pravne odnose, torej pravice in dolžnosti med subjekti mednarodnega prava. Za mednarodno pravo je značilna precejšnja raznovrstnost subjektov. Poleg dveh temeljnih tipov, to so v prvi vrsti države in mednarodne organizacije, obstajajo tudi primeri, ko določene enote izpolnjujejo nekatere, ne pa vseh pogojev za status subjekta mednarodnega prava (Türk, 2015, str. 19.). Najstarejše in najbolj uveljavljeno sredstvo za reševanje mednarodnih sporov na miren način je arbitraža. Gre za postopek, v katerem se stranke lahko dogovorijo glede več temeljnih sestavin. Ravno tako izberejo arbitre, ki izdajo dokončno odločbo. Celotno diplomsko delo se bo navezovalo na primer arbitražne razsodbe med Republiko Slovenijo in Republiko Hrvaško. Omenjeni državi v svoji celotni zgodovini nista imeli natančno določene meje, ne na kopnem ne na morju. Dan D se je zgodil lani,29.6.2017, ko je Stalno arbitražno sodišče v Haagu izdalo končno razsodbo. Po odločitvi sodišča je Slovenija dobila tri četrtine Piranskega zaliva in mednarodni %stik% z odprtim morjem. Vse lepo in prav, sodišče je sodbo izdalo, vsi vemo, da je odločitev treba spoštovati, vendar pa se je Hrvaška odločila, da zaradi napak v postopku enostransko odstopi od arbitraže in posledično odločitve sodišče ne priznava. Glede na prebrano in analizirano literaturo je mnenje slovenskih pravnikov dokaj podobno, skoraj vsi zagovarjajo načelo pacta sunt servanda, ravno tako se temu mnenju pridružujejo slovenski politiki. Odločitev arbitražnega sodišča je dokončna in zavezujoča za obe strani. Na drugi strani se hrvaški pravniki in politiki s tako idejo ne strinjajo, saj zatrjujejo, da glede za napake, do katerih je prišlo med postopkom, zanje arbitraža ni več relevantna. Zagovarjajo in vztrajajo pri tem, da odločitve sodišča ne bodo implementirali.

The international law is the system of legal rules determining legal relations; i.e. rights and responsibilities among the international legal personalities. Considerable diversity of legal personalities is typical of international law. Beside two fundamental types % states and international organisations % there are other specific personalities that comply with some, but not all conditions to gain the status of the international legal personality (Türk, 2015, str. 19). The oldest and the most common means of peaceful resolutions for international disputes is arbitration. In this procedure, the parties can reach agreements about several basic components. They choose arbitrators that make the final decision. This thesis deals with the case of arbitration between the Republic of Slovenia and the Republic of Croatia. The border between these two states on land as well as at the see has never been set in detail. Day D was 29 June 2017 when the Permanent Court of Arbitration in the Hague issued the final decision. According to the final decision, Slovenia gained three quarters of the Gulf of Piran in international connection with the high seas. The verdict was reached and it should be obeyed; however, Croatia decided to withdraw from the arbitration and neglect the decision made by the Court. According to the analysed literature, Slovenian legal experts as well as politicians share the same opinion; they all speak in favour of pacta sunt servanda. The decision of the Court of Arbitration should be final and binding for both parties. On the other side, Croatian politicians and legal experts do not agree with this idea; they claim that mistakes made during the procedure make the arbitration irrelevant for Croatia. They insist and advocate that they will not implement this decision. |
