Povzetek
Arbitraža je sporazumni razsojevalni postopek reševanja spora, kadar se stranke dogovorijo, da bodo obstoječi ali bodoči spor predložile arbitru ali arbitražnemu senatu, ki bo izdal dokončno in pravno zavezujočo arbitražno odločbo. Arbitražni postopek za določitev kopenske in morske meje med Republiko Slovenijo in Republiko Hrvaško pri Stalnem arbitražnem sodišču v Haaguje potekal od podpisa arbitražnega sporazuma med državama 4. novembra 2009 do izreka razsodbe 29. junija 2017. Z njim sta državi želeli dokončno razmejiti ozemlja, kjer meja od osamosvojitve obeh držav ni bila natančno določena ter končati teritorialne spore, predvsem na območju Piranskega zalivana skrajnem jugozahodnem delu meje in ob reki Murina severovzhodu. Po odločitvi sodišča je Sloveniji pripadlo tri četrtine Piranskega zaliva in stik z odprtim morjem, sporni del vasi Brezovec ob Muri in tista ozemlja, kjer so se katastrske površine po evidencah obeh držav prekrivale, a je Slovenija tam aktivneje uveljavljala oblast. Tak primer je vas Draga pri Sekulićih ob Sotli, medtem ko so sporni zaselki ob reki Dragonji na jugozahodu pripadli Hrvaški. Povsod, kjer so bili katastri usklajeni, so arbitri določili mejo po njihovih mejah, ne glede na praktične okoliščine. Sedaj,ko smo pridobili razsodbo,je Hrvaška ne želi spoštovati in implementirati, kot argument pa podaja, da je Slovenija s pogovorom med sodnikom in slovensko agentko kršila postopek arbitraže, zato se je Hrvaška odločila za enostranski odstop od arbitraže. Mnenje slovenskih politikov in pravnikov ter novinarjev je enotno, odločitev je korektna in jo bomo spoštovali in implementirali, tako mnenje imajo tudi druge države Evropske unije, pri tem pa tudi poudarjajo,da je arbitražna odločitev zavezujoča in dokončna.

Arbitration is an amicable dispute resolution procedure where parties agree to submit an existing or future dispute to an arbitrator or an arbitration panel that will issue a final and legally binding arbitration judgment. The arbitration procedure for determining the land and sea border between the Republic of Slovenia and the Republic of Croatia at the Permanent Court of Arbitration in The Hague was conducted from the signing of the arbitration agreement between the countries on 4 November 2009 pending the ruling on 29 June 2017. With it, the two countries wanted to definitively demarcate the territories the border between the independence of both countries has not been precisely defined and the territorial disputes have ended, especially in the Piran Bay area in the far southwestern part of the border and along the Mura River in the north-east. After the court's ruling, Slovenia had three quarters of the Piran Bay and contact with the high seas, the contested part of the village Brezovec ob Muri and those territories where the cadastral areas were covered over according to the records of both countries, but Slovenia actively exercised its power there. An example is Draga near Sekulici near Sotla, while the controversial hamlets along the Dragonja River in the southwest belonged to Croatia. Where the cadastres were coordinated, the arbitrators determined the border at their borders, regardless of practical circumstances. Now that we have obtained a verdict, Croatia does not want to respect and implement verdict, and argues that Slovenia, by talking between a judge and a Slovenian agent, violated the arbitration procedure, so Croatia decided to unilaterally resign from arbitration. The opinon of Slovenia politicians and lawyers and journalists is unanimous, the decision is correct and we will respect and implement it, that kind of opinion have the other countries of the European Union, and they stress that the arbitration decision is binding and final. |
