Abstract

Pojmi skrajna sila, opravičljiva in upravičljiva skrajna sila ter silobran so le eni izmed elementov, s katerimi se srečuje kazensko materialno pravo. Kazensko materialno pravo skupaj s kazenskim procesnim pravom tvori eno od najstarejših pravnih panog  kazensko pravo. V kazenskem pravu najdemo različna pravna pravila, s katerimi država prepoveduje oziroma preprečuje takšna ravnanja posameznika, ki jih v določeni družbi označujejo kot nesprejemljiva, nevarna in zavržna. Cilj zaključnega dela je predvsem osredotočenost na raziskovanje opravičljive in upravičljive skrajne sile, skrajne sile ter silobrana v slovenskem kazenskem materialnem pravu. Primarno se bomo osredotočili na opisovanje koncepta skrajne sile  na ugotovitve in opredelitve elementov skrajne sile  in predstavili dejstva, kdo se sme sklicevati na skrajno silo in v kakšnih primerih ter kdo se v določenih primerih ne sme oziroma ne more sklicevati na skrajno silo. Naš cilj je tudi podrobneje spoznati način vplivanja skrajne sile na kaznivo dejanje, to je katere elemente splošnega pojma kaznivega dejanja izključuje, in natančneje preučiti in opredeliti njene elemente ter značilnosti. V nadaljevanju namenimo pozornost tudi dvema vrstama skrajnih sil, ki jih pozna slovensko kazensko pravo, ter objasnimo, zakaj sploh potrebujemo dve vrsti skrajnih sil in kakšen je njun namen. Pri opisovanju obeh vrst skrajnih sil je poudarek predvsem na ugotavljanju njihovih značilnosti in na primerjavi. Pri tem naredimo tudi vpogled v primere obeh vrst skrajne sile in opišemo pojem silobrana v slovenskem pravu. Poleg že navedenega, poskusimo narediti tudi primerjavo iz pravnega vidika. Primerjali bomo ureditev skrajne sile v slovenskem pravu z ureditvijo le-te v nemškem in avstrijskem pravu.

Secondary abstract: Concepts of extreme force, excusable and justifiable extreme force and self-defense are just some of the elements of the substantive criminal law. Substantive criminal law and criminal procedural law form one of the oldest legal sectors, that is criminal law. In criminal law, we find various legal rules by which the state prohibits or prevents such behavior by an individual who is identified in a particular society as unacceptable, dangerous and rejected. The aim of the thesis is mainly to focus on researching an excusable and justifiable extreme force, extreme force and a self-defense in Slovenian substantive criminal law. We will primarily focus on describing the concept of extreme force  on the findings and definitions of the elements of extreme force  and on the facts about who can rely on the extreme force and in which cases and who in certain cases shall not or can not rely on extreme force. Our aim is also to take a close look at the way in which the extreme force is involved in a criminal offense, i.e. which elements of the general concept of criminal offense does it exclude, and examine in a more precisely manner its elements and characteristics. Furthermore, we give attention to the two types of extreme forces that are familiar with Slovenian criminal law, and explain why we need two types of extreme forces and what is their purpose. In describing both types of extreme forces, the emphasis is mainly on identifying their characteristics and on the comparison of two of them. We also make an insight into the examples of both types of extreme force and describe the concept of self-defense in Slovenian law. In addition to the above, we also try to make a comparison from the legal point of view. We will compare the organization of the extreme force in Slovenian law with the German and Austrian law.
