Abstract
Magistrsko delo proučuje varstvo osebnih podatkov na spletu v luči aktualne ureditve pri nas ter širše v svetu. Z izredno hitrim razvojem spletnih tehnologij se osebni podatki posameznikov vse bolj spreminjajo v trgovsko blago, zato je pomembno, da se je 25. 5. 2018 začela uporabljati nova Uredba (EU) 2016/679 Evropskega parlamenta in Sveta z dne 27. aprila 2016 o varstvu posameznikov pri obdelavi osebnih podatkov in o prostem pretoku takih podatkov ter o razveljavitvi Direktive 95/46/ES (Splošna uredba o varstvu podatkov - z angleško kratico GDPR). Navedena uredba je natančno analizirana v osrednjem delu raziskave, kjer je predstavljen tudi predlog Zakona o varstvu osebnih podatkov (ZVOP-2), ki pa je trenutno še v fazi sprejemanja. Obravnavana je tudi tematika aktualnega dogajanja na področju varovanja osebnih podatkov v vertikalnem razmerju posameznik - država. Tveganja, ki jih prinaša t. i. zakonito prestrezanje komunikacij, so raziskana v poglavju z naslovom Demokracija in zloraba osebnih podatkov. Vsebinski sklop raziskovalnega dela magistrskega dela proučuje izredno aktualne teme, ki so: vprašanje veljavnosti privolitve v obdelavo osebnih podatkov, splošni pogoji poslovanja, piškotki in mobilne aplikacije. V odgovoru na tveganja, ki jim je izpostavljen uporabnik spleta, so v dodatnem poglavju navedeni ukrepi za samozaščito. Gre za katalog praktičnih ukrepov, s katerimi si lahko uporabnik (do določene mere) izboljša in zavaruje svoj položaj. Zadnje vsebinsko poglavje magistrskega dela se ukvarja z računalništvom v oblaku in pozornost posveča pravnim vprašanjem, ki jih to hitro razvijajoče se področje odpira.

The master's thesis examines the protection of personal data on the web in the perspective of current regulation in our country and wider in the world. With the extremely rapid development of online technologies, personal data of individuals are increasingly changing into merchandise, so it is important that from 25th May 2018 we started using the new Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation - with the English abbreviation GDPR). This regulation has been carefully analysed in the central part of the study, where the proposal for the Law on the Protection of Personal Data (ZVOP 2) is presented, which, however, is currently still in the phase of adoption. The topic of current developments in the field of personal data protection in the vertical relation individual - state is also discussed. The risks posed by the so-called lawful interception have been investigated in the chapter entitled Democracy and abuse of personal data. The contents compound of the research part of the master's thesis examines extremely relevant topics, which are the question of validity of consent in the processing of personal data, general business conditions, cookies and mobile applications. In the response to the risks to which the user of the web is exposed, the additional chapter lists the measures for self-protection. It is a catalogue of practical measures that can help the user (to a certain extent) improve and secure his position. The last substantive chapter of the master's thesis deals with cloud computing and focuses on the legal issues that this rapidly developing field opens. |
