Abstract

Pravna razmerja v zavarovalništvu so zaradi svoje posebne narave urejena drugače. Zaradi varstva šibkejše stranke (potrošnika) je zakonodajalec uredil zavarovalno razmerje s prisilnimi predpisi. Poleg tega pa se je vzpostavilo tudi dodatno varstvo zavarovancev z izvensodnim reševanjem sporov v zavarovalnem razmerju. Pri Slovenskem zavarovalnem združenju namreč potrošnik lahko vloži pobudo za začetek postopka mediacije, ki je zanj hitrejši, preprostejši in cenejši postopek v primerjavi s sodnim. Tako se lahko potrošnik izogne sodnemu postopku in reši spor z zavarovalnico na drug način. Glede na statistične podatke je razvidno, da se število pobud pri Slovenskem zavarovalnem združenju povečuje, kar je pokazatelj, da so potrošniki informirani o možnosti mediacije in to možnost tudi uporabljajo. Udeležba v postopku mediacije je za zavarovalnice obvezna, ni pa zavezujoča poravnava, ki jo stranki lahko skleneta ali ne. Kljub temu je postopek mediacije del varstva potrošnikov, ki jim omogoča učinkovitejše uresničevanje potrošniških pravic. Zato je institut za potrošnike koristen, saj je v praksi uporaben in nudi še dodatno varstvo.

Secondary title: Alternative Dispute Resolution of Consumer Disputes arising out of Insurance Contracts
Secondary abstract: Due to their special nature, legal relations in the insurance industry are regulated differently. In order to protect the weaker client-customer, the legislator regulates insurance industry with mandatory regulations. Additionally, another protection was established with alternative consumer dispute resolution. The consumer can file a request to initiate the mediation procedure at Slovenian Insurance Association, which is quicker, simpler and cheaper than litigation. Alternative dispute resolution helps consumer to avoid litigation and to solve dispute differently. According to statistics, the numbers of requests are rising, which indicates that consumers are informed about their option and are using mediation. Participation for insurance companies is mandatory, but they are not obliged to reach a settlement. Nevertheless, mediation offers consumers more suitable enforcement of consumer rights. Because of that, mediation is beneficial for consumers.
