Abstract

Zaradi omejevanja ali neupoštevanja predhodno sklenjenih stavkovnih dogovorov, imajo policisti in zaposleni v policiji za zaščito svojih pravic ali interesov, kot skrajno možnost v boju za svoje ekonomske in socialne interese, pravico uporabiti skrajno zakonsko sredstvo - stavko. V diplomski nalogi je proučena omejitev do stavke v slovenski policiji, zgodovinski in mednarodni razvoj ter pomen stavke. Nadalje je podrobneje opredeljena ustavno varovana pravica do stavke, kot jo določa 77. člen Ustave (»Ustava Republike Slovenije [URS]«, 1991). Cilj diplomske naloge je bil najprej ugotoviti ali so policistom z omejitvijo pravice do stavke kratene ustavne ali zakonske pravice, nadalje omejitev pravice do stavke in ureditev le-te primerjati s sosednjimi državami in nazadnje ugotoviti, kako je omejitev pravice do stavke urejena v drugih javnih službah, bistvenih za delovanje države. V diplomski nalogi je bil kot bistven za izvajanje stavk v policiji, predstavljen tudi policijski sindikat, sklenjene kolektivne pogodbe za policiste ter analizirano trenutno stanje in učinkovitost stavk v policiji. S preučitvijo tujih in domačih pravnih virov ter literature je bilo ugotovljeno, da slovenskim policistom niso kratene pravice, zaradi omejitev pravice do stavke v policiji, kot izhajajo iz 76. člena (»Zakona o organiziranosti in delu v policiji [ZODPol]«, 2013). Ugotovljeno je bilo tudi, da imajo naše sosednje države: Avstrija, Hrvaška in Italija, vsaka po svoje oziroma na pravno drugačen način urejeno pravico ali celo prepoved do stavke v policiji. Ob analizi in primerjavi drugih javnih služb bistvenih za delovanje države, kot so: vojaki, pravosodni pazniki, uslužbenci finančne uprave ali civilne zaščite in reševanja, letalsko osebje in drugo osebje ter veterinarji, je bilo ugotovljeno, da imajo glede na temeljno nalogo organa podobno urejene omejitve pravice do stavke, tako da se tudi v času stavke zagotavlja vsaj minimalen obseg izvajanja osnovnih nalog organa.

Secondary title: Restriction of the Right to Strike in the Slovenian police
Secondary abstract: Due to partial implementation of, or failure to comply with, previously negotiated strike agreements, police officers and police force employees are entitled to use the extreme legal means of a strike in order to protect their rights or interests, as the ultimate means in their fight for their economic and social interests. The present paper examines the restriction of the right to strike in the Slovenian police, the historical and international development, as well as the significance of the mechanism of strike. In addition, the constitutionally protected right to strike, as defined by Article 77 of the Constitution of the Republic of Slovenia (1991), is outlined in detail. The aim of the paper is first of all to determine whether or not the constitutional or statutory rights of the police are violated by restricting their right to strike, then to compare the restriction and regulations of the right to strike with neighbouring countries, and finally to determine how the restriction of the right to strike has been regulated in other public services essential for the operation of the state. The paper introduces the police union as an essential organisation for carrying out strikes in the police, as well as examining police officers’ collective agreements and analysing the current state and efficiency of strikes in the police. By reviewing foreign and domestic legal sources and literature, it was found that the Slovenian police are not deprived of their rights due to restrictions on the right to strike in the police, as referred to in Article 76 of the Police Organization and Work Act (2013). It was also found that the neighbouring countries of Austria, Croatia and Italy have regulated or even prohibited the right to strike in the police force, each in a unique or legally different way. When analysing and comparing other public services essential to the operation of the state – such as soldiers, judicial guards, financial administration employees, civil defence officers, emergency service providers, aviation personnel and veterinarians, as well as other public service employees – it was found that, taking into account the basic task of each respective body, restrictions of the right to strike are organised in a similar way, so that in the event of a strike the continuity of their services is ensured, at least to the minimum extent.
