Abstract

Fokus diplomske naloge je na razmerju med sodobno prakso zasebnosti in Splošno uredbo o varstvu podatkov oziroma iskanju vpliva uredbe na prakso zasebnosti. S pojmom sodobna praksa zasebnosti ciljamo na prepletenost vseh človeških dejavnosti z informacijsko-komunikacijsko tehnologijo, s katero je zaradi obdelave podatkov omogočeno nadzorovanje zasebnosti posameznika. Opredelitve informacijske zasebnosti najpogosteje zajemajo posameznikovo pravico, da sam določa obseg podatkov o sebi, ki bo posredovan drugim – posameznikov samonadzor. Pojmov zasebnost in nadzor torej ne moremo obravnavati ločeno. Koncepta se spajata in sta v definiciji združena. Zaradi ugodja in odvisnosti od uporabe informacijsko-komunikacijske tehnologije ter uvedbe samonadzora v definicijo zasebnosti se je nadzor normaliziral in postal sprejemljiv. Splošna uredba o varstvu podatkov naslavlja nekatere ključne probleme neustrezne zaščite osebnih podatkov posameznika, ki je z upravljavci vedno v asimetričnem razmerju moči. V uredbi smo prepoznali stičišče konceptov zasebnosti in nadzora, saj je eden izmed namenov sprejema Splošne uredbe o varstvu podatkov dodatna okrepitev posameznikovega samonadzora nad tem, kateri njegovi podatki in za katere namene se obdelujejo.

Secondary title: The Relation between the Contemporary Privacy Practices and the General Data Protection Regulation
Secondary abstract: The focus in this diploma thesis is on relation between the contemporary privacy practices and the General Data Protection Regulation or the search of the regulation impact on the privacy practices. With the notion of the contemporary privacy practice, we aim at intertwining all human activities with information and communication technology, which due to data processing, enables the control of individual privacy. The information privacy definition often includes the individual's right to determine the extent of one’s information, that would be passed to others – the individual self-control. The notions of privacy and control could not be considered separately, because they are merged in the definition. Due to the comfort and dependency on the uses of information and communication technology, and the introduction of self-control within the definition of privacy, control became normalized and acceptable. The General Data Protection Regulation addresses some of the key problems of inadequate protection of individual's personal data, who is in an asymmetrical power relation with controller. In the regulation we have identified the junction of the concepts of privacy and control. One of the main purposes of the General Data Protection Regulation adoption, was an additional strengthening of the individual self-control over what data, and for which purposes are being processed.
