Abstract

Plačilo za delo je eden izmed temeljnih institutov delovnega prava. Pravna ureditev plačila za delo je pomembna tako za posameznega delavca in delodajalca, kot tudi za celotno družbo ter njen socialni in ekonomski razvoj. Temelj plačnega sistema v zasebnem sektorju je pravna ureditev v kolektivnih pogodbah (trenutno v kolektivnih pogodbah dejavnosti), izjemno pomembna in nujna pa je tudi ustrezna zakonska ureditev. Veljavna zakonska ureditev je sicer solidna, vseeno pa bi bile primerne nekatere spremembe in dopolnitve. Dobrodošle bi bile tudi določene posodobitve ter bolj enotna ureditev na ravni avtonomnega pravnega urejanja, vključno s sprejemom splošne kolektivne pogodbe za zasebni sektor. Avtor najprej predstavi nedosledno uporabo različnih pojmov ter s tem povezane terminološke probleme. Nato prikaže ureditev plačila za delo v mednarodnih in notranjih pravnih virih. Nadalje analizira posamezne sestavine plačila za delo, ki so določene v ZDR-1 ter v kolektivnih pogodbah. Avtor obravnava tudi ureditev varstva plače, minimalne plače ter najnižjih osnovnih plač, določenih v kolektivnih pogodbah. V sklepu predstavi glavne pomanjkljivosti veljavne pravne ureditve plačila za delo v zasebnem sektorju ter predlaga ustrezne spremembe in posodobitve.

Secondary title: Legal regulation of remuneration for work in the private sector
Secondary abstract: Remuneration for work is one of the fundamental institutions of labour law. Legal regulation of remuneration for work is important both for the individual worker and employer, as well as for the whole society and its social and economic development. The wage system in the private sector is based on the legal regulations in collective agreements (currently in sectoral collective agreements). The appropriate legislation is also extremely important and necessary. The current legislation is good, but some amendments and additions are needed. Certain modifications and more unified regulation in the area of autonomous legal regulation, including the adoption of the overall intersectoral collective agreement for the private sector, would also be welcome. The author first presents the inconsistent use of different terms and related terminological problems. Then he presents legal regulations of remuneration for work in international and domestic legal sources. Furthermore, the author analyzes the individual components of remuneration for work laid down in the Employment Relationship Act and collective agreements. He also discusses the regulation of protection of wages, minimum wage and minimum basic salaries, which are laid down in collective agreements. In conclusion, he presents the main shortcomings of the current legal regulation of remuneration for work in the private sector and proposes appropriate modifications.
