Abstract

Načelo demokratičnosti je eno izmed temeljnih ustavnih načel, na kateri sloni sodobna demokratična država. Sodobne demokracije temeljijo na načelu ljudske suverenosti, na podlagi katerega je nosilec suverene oblasti lahko samo ljudstvo. Iz načela ljudske suverenosti izhaja tudi načelo demokratične države. Sodobna demokracija se udejanja predvsem kot posredna demokracija, ki je vzpostavljena z volitvami. Gre za parlamentarno demokracijo, v kateri sprejema temeljne odločitve v družbi predstavniško telo (parlament) kot tisti državni organ, ki predstavlja ljudstvo kot celoto in deluje v njegovem imenu. Ta organ v okviru svojih pristojnosti opravlja zakonodajno funkcijo, kot eno izmed najpomembnejših funkcij. V Republiki Sloveniji predstavniško telo predstavlja Državni zbor. V prvem delu diplomskega dela je predstavljen zgodovinski razvoj in idejni koncept načela delitve oblasti in sistema organizacije oblasti v Republiki Sloveniji. Ta vidik je osvetljen tako z zgodovinskega kot primerjalnega stališča. Osrednji del naloge obsega opredelitev Državnega zbora kot predstavniškega telesa v Republiki Sloveniji. Diplomsko delo opredeljuje pristojnosti zakonodajalca v slovenski pravni ureditvi, pri čemer se podrobneje osredotoča na zakonodajno funkcijo državnega zbora kot poglavitnega zakonodajnega državnega organa v Republiki Sloveniji. V okviru poglobljene opredelitve zakonodajne funkcije Državnega zbora je v zadnjem delu diplomskega dela opravljena primerjalna analiza zakonodajnega delovanja poslancev Državnega zbora v šestem (2011-2014) in sedmem mandatnem obdobju (2014-2018) Republike Slovenije.

Secondary abstract: The principle of democracy is one of the fundamental constitutional principles on which a modern democratic state is based. Modern democracies are based on the principle of the people's sovereignty, on the basis of which the bearer of the sovereign power can only be people. From the principle of human sovereignty also follows the principle of a democratic state. Modern democracy is largely a part of the indirect democracy established by the elections. It is a parliamentary democracy in which the fundamental decisions of the society are taken by the representative body (parliament) as that state body that represents the people as a whole and acts on its behalf. Within its competences, this authority carries out its legislative function as one of the most important functions. In the Republic of Slovenia, the National Assembly represents the representative body. The first part of the thesis presents the historical development and the conceptual concept of the idea of separation of powers and the system of the organization of power in the Republic of Slovenia. This aspect is illuminated both from the historical and the comparative point of view. The central part occupies a detailed breakdown of the definition of the National Assembly as a representative body in the Republic of Slovenia. The thesis defines the competences of the legislator in the Slovenian legal system, focusing on the legislative function of the National Assembly as the main legislative body in the Republic of Slovenia. In the framework of an in-depth definition of the legislative function of the National Assembly, the final part of thesis analyzes the legislative work of the members of the National Assembly in the VI. (2011-2014) and VII. mandate (2014-2018) in Republic of Slovenia.
