Abstract

V doktorski disertaciji obravnavamo stanje pravne kulture v slovenskih osnovnih šolah, predvsem na podlagi praktičnega dela z akterji šolskega življenja: strokovnimi delavci v šolah, učenci in starši, saj doslej ni bilo poglobljenih raziskav s tega področja prava v Sloveniji. Preverjamo hipoteze, da je pravna kultura v slovenskih osnovnih šolah slaba zaradi nepoznavanja in ignorance prava, nezakonitosti splošnih pravnih aktov avtonomnega prava, kršitev človekovih pravic, medvrstniškega nasilja, slabe komunikacije med akterji in zlorabe anonimnih prijav. Definiramo pravno kulturo in jo preslikamo na področje šolskega prava. Uporabimo naslednje metode raziskovanja: analizo in interpretacijo, induktivno-deduktivno metodo, metodo deskripcije, komparativno metodo, normativno metodo, metodo ankete, metodo kompilacije, sintetično, dogmatično, aksiološko, sociološko, zgodovinskopravno, in primerjalnopravno metodo. Opišemo projekte, s katerimi želi avtorica aktivno vplivati na izboljšanje pravne kulture v slovenskih osnovnih šolah. Raziščemo tudi problematiko zlorabe instituta anonimnih prijav, otrok s posebnimi potrebami in medvrstniškega nasilja, še posebej spletnega, ki v času vse dostopnejše tehnologije stalno narašča. Posebej poudarimo pomen mirnega reševanja sporov, zlasti se posvetimo vrstniški in šolski mediaciji, ki ju avtorica skuša z aktivnim delovanjem približati slovenskim osnovnim šolam. Vpeljemo pojem zunanje šolske mediacije, s katero se avtorica ukvarja kot mediatorka. Opišemo pozitivne učinke šolske in vrstniške mediacije in raziščemo vpliv mediacije na oblikovanje pravne kulture posameznika in družbe. Pri pisanju disertacije se je avtorica morala zanašati predvsem na lastno raziskovalno delo, saj v slovenskem prostoru obstaja le peščica del na obravnavano temo, pa še ta jo pokrivajo le delno.

Secondary abstract: In this dissertation, we explore the state of legal culture in Slovenian primary schools, primarily referring to the practical work involving various actors of school life: school professionals, students and parents, since there had been no thorough researches of this field of law in Slovenia before this paper. We evaluate the hypotheses that legal culture in Slovenian primary schools is bad due to the ignorance of law, illegal general acts of autonomous law, violations of human rights, peer violence (bullying), poor communication between the actors and misuse of the institute of anonymous reports. We define legal culture and extrapolate it to the field of school law. The following methods of research are used: analysis and interpretation, inductive-deductive, descriptive, comparative, normative, poll, compilation, synthetic, dogmatic, axiological sociological, legal historical and legal comparative method. We describe the projects with which the author tries to influence improvement of legal culture in Slovenian primary schools. We also explore the issues of anonymous reports misuse, children with special needs and peer violence (bullying), especially web-based violence which has been growing constantly along with ever easier accessibility of technology. We explicitly emphasize the importance of peaceful conflict resolution, focusing primarily on school- and peer mediation, which the author has actively promoted in Slovenian primary schools. We introduce the concept of external school mediation in which the author has been acting as a mediator. We describe the positive effects of school- and peer mediation, and explore the influence of mediation on forming the individual's and the society's legal culture. The author had to depend mainly on her own research work when writing this dissertation, since there were not many research papers covering the theme, and even those existing covered it only partially.
