Abstract
V uvodu diplomske naloge lahko razberemo, kaj pomeni osebna svoboda in svoboda gibanja, da je to osnovna dobrina in temeljna svoboščina ter njeno zakonsko opredelitev, na katero je vezana predvsem Ustava Republike Slovenije ter drugi Mednarodni akti. Spoznali bomo nekaj drugih pravic, ki so povezane z odvzemom prostosti oziroma posameznikovo svobodo. V nadaljevanju je podrobneje opredeljena osebna svoboda, razlika med primarnim ter sekundarnim posegom v osebno svobodo ter dobimo globlji vpogled v primaren poseg v osebno svobodo. Seznanimo se, kaj pomeni odvzem prostosti, kateri pojmi so povezani s samim odvzemom prostosti, kakšna je razlika med privedbo, pridržanjem in zadržanje ter kaj pomeni protipraven odvzem prostosti. V povezavi s samim odvzemom prostosti opredelimo različne postopke, kot so predkazenski, prekrškovni in policijsko varnostni postopek. Pri sami nalogi izvemo tudi to, da Ustava Republike Slovenije, zakoni in drugi pravni akti ščitijo naše pravice in svoboščine, hkrati pa po določenih zakonih dajejo s pooblastili organu oblasti možnost, da posamezniku odvzame prostost. Podrobneje se naloga poglobi v zakone, ki so vezani na odvzem prostosti. Na podlagi teh zakonov usvojimo tudi boljše razumevanje v razlikovanje med primarnim in sekundarnim posegom v osebno svobodo ter spoznamo, da se za odvzem prostosti uporablja različna terminologija, postopki in pogoji, kdaj se lahko posamezniku poseže v osebno svobodo. V zaključnem delu diplomske naloge izvemo še, katere so pravice posameznika v samem postopku odvzema prostosti.

In the introduction to the diploma thesis, we can gather information about what is the meaning of the personal freedom and freedom of movement, that those two are basic goods and fundamental freedoms and its legal definition to which the Constitution of the Republic of Slovenia and other international acts are bound. We will get to know some of the other rights that are related to deprivation of liberty. The Thesis provides us with a specific definition of personal freedom, the difference between primary and secondary interference with personal freedom, and a deeper insight into the primary interference with personal freedom. We get to know what deprivation of liberty means, what concepts are connected with the deprivation, what is the difference between bringing, detaining and detaining, and what constitutes unlawful deprivation of liberty. In connection with the deprivation of liberty, we define different procedures such as pre-criminal, misdemeanor and police security procedures. Through the thesis, we also learn that the Constitution of the Republic of Slovenia, laws and other legal acts protect our rights and freedoms, and at the same time, under certain laws, we give the possibility through the powers of the public authority to deprive the individual of his freedom. The thesis gets a deeper insight into the laws which are connected to the deprivation of liberty. Based on these laws, we also gain a better understanding of the distinction between primary and secondary interference with personal freedom and realize that different terminology, procedures and conditions are used for deprivation of liberty. In the final part of the thesis, we will find out which rights of the individual are in the process of deprivation of liberty. |
