Abstract

Leta 2012 je stopila v veljavo novela Zakona o kazenskem postopku (ZKP-K), s katero je bila uvedena sodba na podlagi priznanja krivde. V magistrskem delu se avtor osredotoča na omejena pravna sredstva, ki jih ima obdolženec v primeru priznanja krivde, in jih primerja s pravnimi sredstvi v rednem kazenskem postopku. Pravico do pravnega sredstva obravnava ob upoštevanju, da gre za ustavno pravico, ki uživa posebno varstvo, kot tudi, da gre za konvencijsko pravico, ki je opredeljena v Evropski konvenciji o človekovih pravicah. Avtor se osredotoča tudi na druga odprta vprašanja pozitivnopravne ureditve. Po primerjalnopravnem pregledu ameriške in nemške ureditve se avtor v sklepnih ugotovitvah tega dela opredeli do ureditve de lege lata in predlaga spremembe de lege ferenda.

Secondary title: Legal remedies against judgment on the basis of a guilty plea
Secondary abstract: In 2012 amendments of the Criminal Procedure Act of the Republic of Slovenia (ZKP-K) entered into force introducing judgment on the basis of a guilty plea. In the Master's thesis, the author considers the limited legal remedies available to the accused in the event of a guilty plea and compares them with legal remedies in a regular criminal procedure. The divergent legal remedies are reviewed in the context of both constitutional rights and the rights enshrined by the European Convention on Human Rights. The author also focuses on other unsettled issues of positive law regulation. Following a comparative review of procedural approaches in the United States and Germany, the author concludes with proposals of reform to the current law.
