Abstract
Letalski promet je ena najmlajših transportnih panog, ki se je pojavila šele v začetku prejšnjega stoletja. Skozi zgodovino je doživljala zelo hiter razvoj, ki je danes pripeljal do tega, da je potovanje z letalom že nekaj povsem vsakdanjega. Pojav nove prometne panoge in novega načina potovanja je s seboj seveda prinesel potrebo po pravni ureditvi tega področja in tako smo skupaj z naglim razvojem letalske industrije, bili priča tudi hitremu razvoja mednarodnega letalskega prava ali pa vsaj poskusu, kako temu hitremu razvoja uspešno slediti s pravnimi pravili. Letalsko javno pravo ureja suverenost države v zračnem prostoru in njegove kršitve, zrakoplove, letalsko osebje in drugo. Njegov razvoj se je začel že leta 1910, najpomembnejša konvencija pa je Čikaška konvencija iz leta 1944, ki še danes predstavlja primaren vir letalskega prava. Letalsko zasebno pravo pa se je začelo s sprejetjem Varšavske konvencije, ki je bila v naslednjih letih večkrat spremenjena in dopolnjena. Za vse te dokumente skupaj z Varšavsko konvencijo se je uveljavil kar termin varšavski sistem. Zaradi razdrobljenosti in nepreglednosti pa je celoten varšavski sistem leta 1999 nadomestila Montrealska konvencija, ki je celotno področje uredila v enem samem mednarodnopravnem dokumentu.

Secondary abstract: |
Air transport is one of the youngest transport industries and emerged only at the beginning of the previous century. Throughout the history it has undergone a rapid development which has led us to the point where traveling by plane is something quite common today. Beginning of a new transport industry and a new way of traveling, brought with it the need to regulate this field. Together with the fast development of the aviation industry we also witnessed the rapid development of international aviation law, or at least an attempt to successfully follow this development with legal rules. Public aviation law governs the sovereignty of the state in airspace and its violations, aircraft, airline personnel and more. Its development began as early as 1910 and the most important convention is the Chicago convention, which represents the main source of aviation law even today. On the other hand, private aviation law began with adoption of the Warsaw convention, which was amended several times during the following years. All those documents together with the Warsaw convention came to be known as the Warsaw system. Due to fragmentation and confusion the whole system was replaced by the Montreal convention in 1999, which regulated the whole area in a single international document. |
