prevajanje izbranih pravnih kulturemov angleškega in slovenskega pravnega sistema
Abstract
Magistrsko delo obravnava opredelitev in analizo prevodov edinstvenih pravnih konceptov, ti. pravnih kulturemov, ki obstajajo zgolj v določenem pravnem sistemu ter posledično lahko povzročijo težave pri prevajanju in pravni komunikaciji nasploh. Delo se osredinja na pravne kultureme angleškega pravnega sistema, ki spada v anglo-ameriško pravno družino, in pravne kultureme slovenskega pravnega sistema, ki spada v kontinentalno pravno družino. Teoretični del magistrskega dela obsega opredelitev in opis raziskave, predstavitev bistvenih razlik med dvema velikima pravnima sistemoma ter različne pristope teoretikov, ki se ukvarjajo s pravnim prevajanjem. Nadaljnje sledi opredelitev možnih prevajalskih strategij in rešitev pri prevajanju pravnih kulturemov. Raziskava se osredotoča predvsem na leksikalno oziroma terminološko raven besedil, ki je tudi predmet empiričnega dela magistrskega dela. V empiričnem delu naloge so opredeljeni in opisani izbrani pravni kulturemi, nakar so podani primeri prevodov, pretežno s strani Eur-Lex in Evrokorpus, kjer lahko najdemo spletno dostopne pravne prevode v slovenščini in angleščini. Na primeru izbranih prevodov v slovenščino in angleščino je prikazano, kako so bili pravni kulturemi preneseni v ciljno besedilo, katerega ozadje pozna le določen pravni sistem, in kakšne prevajalske strategije so bile izbrane. Delo se ogiba izpostavljanju slabih prevajalskih rešitev, saj je opredelitev tega pogosto odvisna od učinka, ki naj bi ga ciljno besedilo dosegalo.

The Master's thesis addresses the determination and analysis of translations of system-bound legal concepts - legal culturemes, that exist only in a particular legal system and, therefore, may cause problems in translation and legal communication in general. The paper focuses on legal culturemes of the English legal system, which belongs to the Anglo-American legal family, and legal cultures of the Slovenian legal system, which belongs to the Continental legal family. The theoretical part of the thesis comprises the determination and description of the research, the presentation of the essential differences between the two major legal systems, and the different approaches of legal translation theorists, followed by the identification of possible translation strategies and solutions for the translation of legal culturemes. The research focuses primarily on the lexical or terminological level of texts, which is also the subject of the empirical part of the master's thesis. The empirical part of the thesis identifies and describes selected legal culturemes, followed by examples of translations, mainly by Eur-Lex and Evrokorpus, where online legal translations can be found in Slovene and English. Selected translations into Slovene and English demonstrate how legal culturemes were translated into the target text, the background of which is only familiar with a particular legal system, and which translation strategies were chosen. The thesis avoids highlighting poor translation solutions, since it often depends on the effect the target text is expected to achieve. |
