Abstract

V preambuli Konvencije o otrokovih pravicah je navedeno, da mora otrok za poln in harmoničen razvoj svoje individualnosti odraščati v družinskem okolju, v sreči, ljubezni in razumevanju in da si morajo države prizadevati, da bi otroci odraščali v urejenem družinskem in življenjskem okolju. Vsaka država naj bi zagotovila ukrepe, s katerimi bo skrbela za varstvo otrokovih koristi. Tretji člen Konvencije o otrokovih pravicah opredeljuje načelo največje koristi otroka, ki določa, da naj bodo pri vseh dejavnostih v zvezi z otroki, otrokove koristi glavno vodilo. Bistvo diplomskega dela je predstaviti, kje so bile kršene človekove oziroma otrokove pravice in na kakšen način bi jih morala vsaka država upoštevati pri mednarodnih posvojitvah. Spodbuditi je treba države, da spoznajo, da mednarodna posvojitev predstavlja alternativen in včasih edini način skrbi za otroka, če zanj ni mogoče najti druge možnosti, še posebej, če gre za otroke, ki so bolni in so ostali brez bioloških staršev ter so prisiljeni biti in ostati več let v sirotišnicah.

Secondary abstract: For the full and harmonious development of his personality, a child must grow up in a family environment, in happiness, love and understanding. Each country must strive to ensure that children grow up in a family environment. Each country should provide measures to protect the interests of the child. Article 3 of Convenction on the Rights of Child (UNCRC) defines the principle of the best interests of the child, which stipulates that in all activities related to children, the best interests of the child shall be a primary consideration. The essence of this thesis is to present where human or children's rights have been violated and in what way each country should take them into account in international adoptions. Efforts should be encouraged to make countries realize that international adoption is an alternative and sometimes the only way to care for a child if no other solution can be found, especially for children who are ill and have lost their biological parents and are forced to be and remain in orphanages for many years.
