Abstract

Hiter razvoj tehnologij prinaša spremembe tudi na področje kazenskega prava. Organi kazenskega pregona se srečujejo z vedno več dokazi v digitalni obliki. Pridobivanje digitalnih dokazov jim ovira uporaba enkripcije. Enkripcija spremeni podatke iz berljive oblike v neberljivo, za dekriptiranje pa je potreben ključ oz. geslo. Pred predajo gesla osebe ščiti privilegij zoper samoobtožbo. Privilegij zoper samoobtožbo je pravica posameznika, da ne priča proti samemu sebi. V diplomski nalogi bomo preverili, kako je privilegij v povezavi z digitalnimi dokazi urejen v Republiki Sloveniji, Veliki Britaniji in Združenih državah Amerike. Biometrična enkripcija za ključ uporablja biometrične podatke, kot so prstni odtis, očesna šarenica ipd. Skozi diplomsko nalogo ugotavljamo, ali biometrični podatki uživajo enako zaščito pod privilegijem zoper samoobtožbo. Predstavljena bo Doktrina testimonialne biometrije, ki predstavlja eno izmed možnih rešitev dileme biometrične enkripcije. V povezavi z Doktrino vnaprej določenega zaključka (The Foregone Conclusion Doctrine), bomo ugotavljali kdaj lahko oblast zahteva predajo gesel, biometričnih podatkov, ali dekriptirano vsebino elektronske naprave. Tehnologija neprestano napreduje, storilci kaznivih dejanj pa so eni prvih, ki po njej posežejo. Za učinkovito reševanje kaznivih dejanj, se morajo prilagajati organi kazenskega pregona in zakonodaja.

Secondary abstract: Exceedingly fast technological development has brought changes to the field of criminal law. Law enforcement agencies have been dealing with increasing amount of digital evidence. Acquiring said evidence has been hindered by encryption. Encryption changes readable text to unreadable and changing it back requires decryption which can only be done by a key or a password. Compulsion of passwords is protected under the privilege against self-incrimination. Privilege against self-incrimination is the right to not stand as a witness against oneself. In the undergraduate thesis we will study the regulation of digital evidence in relation to the privilege against self-incrimination in Republic of Slovenia, Great Britain and United States of America. Biometric encryption uses biometric data such as fingerprint or iris scan, instead of a key or a password. Through the thesis we will establish if the biometric data enjoys same protection as passwords under the privilege against self-incrimination. Testimonial biometrics doctrine will be introduced as one of possible solutions to the dilemma of biometric encryption. In correlation to The Foregone Conclusion Doctrine we will ascertain when the government can demand surrender of passwords, biometric data or decrypted contents of electronic devices. Technology is constantly advancing and perpetrators of criminal acts are the first to use it. Law enforcement and legislation needs to adapt to be able to solve crimes efficiently.
