Abstract
Da lahko policija svoje naloge po pričakovanju družbe opravlja kar se da učinkovito, potrebuje policist potrebna policijska pooblastila. Policiji so pooblastila dana kot orodje za to, da lahko z njimi uspešno in učinkovito opravlja z zakoni in podzakonskimi predpisi določene naloge. Vstop v tuje stanovanje in druge prostore ima slovenska policija natančno opredeljena v različnih zakonih, saj je stanovanje prostor, kjer posameznik upravičeno pričakuje zasebnost.
Cilj diplomske naloge je s pomočjo literature podrobneje opisati vstop v tuje stanovanje po obstoječi zakonodaji v Republiki Sloveniji.
S pomočjo literature smo pojasnili, kakšne so bistvene razlike med hišno preiskavo in vstopom v tuje stanovanje. Ugotovili smo, da nobene hišne preiskave ne moremo opraviti, ne da bi pred tem vstopili v tuje stanovanje ali prostore, bistvena razlika pa se nahaja v »intenzivnosti« pregleda prostora.
S pomočjo statističnih podatkov policije za leto 2019 smo med seboj primerjali, koliko vstopov na podlagi hišne preiskave na 100.000 prebivalcev je opravila določena policijska uprava.
S preučitvijo statističnih podatkov policije smo naredili graf, ki prikazuje število vstopov v tuje stanovanje na podlagi hišne preiskave za obdobje desetih let (2010–2019). Graf prikazuje, da so številke skozi leta približno enake.
Med seboj smo primerjali zakonodajo na področju vstopa v tuje stanovanje in druge prostore med Republiko Hrvaško in Republiko Slovenijo, kjer smo ugotovili, da je zakonodaja na tem področju zelo podobna.

In order for the police to be able to perform the job and tasks that the society expects them to, and to do that as efficiently as possible, the police officers need the necessary police powers. Certain powers and authorisations are given to the police, as a tool to efficiently and effectively perform tasks that are specified by laws and regulations. Entrance in a private residence and private premises is precisely defined by the Slovenian police in various laws, as the apartment is a place where an individual rightly expects privacy.
The aim of this diploma thesis is to describe in more detail the entry into a foreign apartment according to the existing legislation in the Republic of Slovenia.
With the help of the literature, we explained what the essential differences are between a house search and entering a private apartment. We found that no house search could be performed without first entering a private apartment or premises, and the essential difference lies in the “intensity” of the inspection of the premises.
With the help of police statistics for 2019, we compared how many entries based on a house search per 100,000 inhabitants were performed by a particular police administration in Slovenia. By examining police statistics, we made a graph showing the number of entrances to a private residence based on a house search for a period of ten years (2010 - 2019). The graph shows that number do not differ much over the years.
We compared the legislation in the field of entry into a private residence and other premises between the Republic of Croatia and the Republic of Slovenia and we found that the legislation between the countries is very similar. |
