Abstract

Obstoj ponarejenih medicinskih izdelkov je globalni problem, ki predstavlja nesprejemljivo tveganje za javno zdravje. Škodi pacientom in spodkopava zaupanje v farmacevtsko industrijo, zdravstvene delavce in zdravstveni sistem. Evropska unija je s svojo zakonodajo v zadnjem desetletju naredila velik korak v boju proti ponarejenim zdravilom. Slovenija je zaradi implementacije evropskih predpisov v svoj pravni red leta 2014 izdala nov Zakon o zdravilih. Svet Evrope verjame, da je za uspešen boj proti distribuciji ponarejenih zdravil ključno mednarodno sodelovanje, zato leta 2011 sprejme konvencijo Medicrime. Tako dobimo tudi prvo in edino mednarodno pogodbo, ki inkriminira dejanja na tem področju. V misiji preprečevanja ponarejanja zdravil imajo nezanemarljivo vlogo tudi ostale mednarodne institucije, kot sta Svetovna zdravstvena organizacija in Evropska agencija za zdravila, ter nacionalne institucije, Javna agencija za zdravila in medicinske pripomočke, Zavod za preverjanje avtentičnosti zdravil in mnoge druge vladne in nevladne organizacije. V diplomskem delu so predstavljene omenjene institucije in njihova vloga v boju proti ponarejenim zdravilom. Predstavljena je tudi strategija izbranega farmacevtskega podjetja na tem področju in njihovi preventivni ukrepi, načini odkrivanja morebitnih ponarejenih zdravil in ukrepi v primeru odkritega ponaredka.

Secondary title: Measures of selected pharmaceutical company in the field of falsified medicines
Secondary abstract: The existence of falsified medical products is a global problem which represents an unacceptable risk to public health. It harms patients and undermines trust in the pharmaceutical industry, healthcare professionals and healthcare system. The European Union with its legislation has taken a major step in the fight against falsified medicines over the last decade. Slovenia issued a new Medicines Act in 2014, due to the implementation of European regulations in its legal order. The Council of Europe believes that international cooperation is a key to successfully combating the distribution of falsified medicines, therefore in year 2011 adopted the Medicrime Convention. With Medicrime Convention we obtain the first and only international treaty that incriminate criminal actions in this area. Other international institutions, such as the World Health Organization and the European Medicines Agency, also have a significant role in the mission to prevent counterfeiting of medicines. As well as national institutions - the Agency for Medicinal Products and Medical Devices of the Republic of Slovenia (JAZMP), the Institute for the Authentication of Medicinal Products (ZAPAZ) and many other governmental and non-governmental organizations. This diploma thesis presents aforementioned institutions and their role in the combating against falsified medicines. It also presents the strategy of selected pharmaceutical company in this field and their preventive measures, their ways of detecting potential falsified medicines and actions in case of detected falsification.
