Abstract

Nakup nepremičnine je za posameznika velik finančni zalogaj in po navadi enkratno dejanje. Ker na nakupno izbiro vplivajo razmere na trgu in posameznikova čustva, je kupec pri tem izpostavljen velikim tveganjem. Da bi se lahko pri nakupu ustrezno zaščitil, je pomembno, da pozna proces, tveganja in zakonodajo, ki mu omogoča omejitev tveganj, ali da se obrne na ustreznega strokovnjaka. Ugotovili smo, kako se kupci obnašajo pri nakupu nepremičnine in zakaj se tako obnašajo, ter pregledali relevantno zakonodajo, ki ureja promet z nepremičninami. Skozi proces nakupa smo identificirali tveganja ter predstavili ukrepe za omejitev teh tveganj. S pregledom relevantne zakonodaje smo prišli do ugotovitve, da je za nakup nepremičnine potrebno poznavanje več različnih zakonov. Zato ni presenetljivo, da smo z anketiranjem kupcev nepremičnin med drugim tudi ugotovili, da večina nima potrebnega znanja za varno izvedbo nakupa nepremičnine. Žal se je v raziskavi potrdila bojazen, da si kupci kljub neznanju pri nakupu ne poiščejo pomoči ustreznega strokovnjaka. V delu smo dokazali, da je razen manjših pomanjkljivosti v Republiki Sloveniji zakonodaja za zaščito kupca pri nakupu nepremičnine ustrezna. Težava je v tem, da je razpršena in kompleksna ter s tem za povprečnega kupca prezahtevna. Ker se je izkazalo, da je ozaveščenost kupcev o nevarnostih, ki se jim pri nakupu nepremičnine izpostavijo, nezadostna, menimo, da bi lahko država zakonsko poskrbela za obveznost angažiranja strokovnjaka, kadar kupec nima ustreznega znanja oz. izobrazbe

Secondary abstract: Buying a property is a big financial step and usually a once in a lifetime action for an individual. Because individuals% purchase choice is influenced by market conditions and emotions, the buyer is exposed to great risks. To be able to adequately protect his or her interests when making a purchase, he/she must know the process, the risks and the legislation that allows to limit the risks or to turn to the appropriate expert. We investigated how buyers behave when they are buying a home and why, and reviewed the relevant legislation governing real estate transactions. Through the purchase process, we identified the risks and presented measures to limit these risks. By reviewing relevant legislation, we concluded that the purchase of real estate requires an understanding of several different laws. Therefore, it is not surprising that by surveying real estate buyers, we found that most do not have the necessary knowledge to make a safe purchase. Unfortunately, the research confirmed our concern that buyers while buying a property do not seek the help of a suitable expert despite their lack of knowledge. Throughout the paper, we have proven that, except minor shortcomings, our legislation protecting the buyer when buying real estate is adequate. The problem is that it is dispersed and complex, and as such too demanding for an average buyer. Because the awareness of buyers about the dangers they are exposed to when buying real estate is insufficient, we think that the state should enforce a legal obligation for buyers to hire an expert when they do not have the appropriate knowledge or education
