Abstract

V magistrskem delu smo obravnavali javna naročila in pravno podlago zanje, katera določa načela in postopke, ki usmerjajo uporabo javnega naročanja v praksi. Ob tem smo navedli pravila in smernice s področja javnega naročanja, ki so podana na ravni EU. Ker so javna naročila del nabavnega poslovanja, smo preučili nabavo in nabavno funkcijo v javni ustanovi. Leto 2020 je zaznamovala epidemija, zaradi katere je bilo potrebno narediti na vseh področjih nekaj sprememb. Iz tega razloga smo si pogledali, kakšno je bilo stanje v tem času na področju javnih naročil tako v domačem okolju kot tudi smernice, ki so bile podane s strani EU. V empiričnem delu naloge smo izbrali dva že izvedena naročila v določeni javni ustanovi in ju podrobneje preučili. Naročili sta vsebovali isti predmet naročila, glede na vrste javnih naročil in se vsebinsko nista veliko razlikovali. Na podlagi raziskanega smo ugotavljali, kakšne posledice in vplive je v tej izbrani ustanovi pustila epidemija COVID-19. Ugotovili smo, da kljub visoki vključenosti omenjenega virusa v izbrani ustanovi na področju zdravstvenih storitev, le-ta ni imel tako visokega vpliva na naše raziskovano področje javnih naročil, ki je del nabave v njej.

Secondary abstract: In this master's thesis, we discussed the public procurement and the legal basis for it, which sets out the principles and procedures that guide the use of public procurement in practice. We also listed the rules and guidelines in the field of public procurement, which are given at the EU level. Since the public procurement is a part of the procurement business, we made a thorough analysis of it and examined the procurement function in a public institution. The year 2020 was marked by the Covid-19 epidemic, which demanded the changes in all areas. For this reason, we analyzed the situation at that time, in the field of public procurement. This was done both by checking the domestic environment and the guidelines given by the EU. In the empirical part of the thesis, we selected two already executed orders in a certain public institution and examined them in more detail. The contracts contained the same subjects as public procurement contracts should and did not differ much in its content. Based on the research, we determined the consequences and impacts of the COVID-19 epidemic in the selected institution. We found that despite the high involvement of the virus in the selected institution in the field of health services, there was no high impact of it in our researched area of public procurement.
