Abstract
Onesnaževanje in uničevanje okolja predstavljata enega izmed glavnih problemov sodobne družbe, ker tovrstna dejanja škodujejo človeštvu so ta zakonsko prepovedana. Pri dejanjih obremenjevanja in uničevanja okolja pričnemo govoriti o ekološki kriminaliteti, katera obsega vsakršno dejanje ogrožanja in obremenjevanja okolja in je kot tako prepovedano s kazensko zakonodajo. Posebnost tovrstne kriminalitete predstavlja zapletenost in dolgotrajnost pri preiskovanju tovrstnih kaznivih dejanj in predstavljajo eno izmed najbolj razvijajočih in najzapletenejših vrst kriminalitete v svetu. Področje ekološke kriminalitete predstavlja polje zanimanja najrazličnejših znanstvenih ved, saj je pri razumevanju le te potrebno ohranjati multidisciplinaren, interdisciplinaren in transdisciplinaren pogled. Ekološka kriminaliteta predstavlja predmet preučevanja ekološke kriminologije, družboslovne vede, katera preučuje oblike ogrožanja okolja, okoljevarstveno zakonodajo ter okoljevarstvene ukrepe. Varovanje okolja je najuspešnejše ob zaščiti okolja s celovitimi ukrepi varovanja pri katerih največjo vlogo igra pravno varstvo okolja. V Sloveniji pravno varstvo okolja predstavljajo zakonski ter podzakonski pravni akti, med katerimi glavno vlogo igra Kazenski zakonik, v katerem so zajeta kazniva dejanja zoper okolje, prostor in naravne dobrine. Zakonodajalec v Sloveniji skrb za odkrivanje, preiskovanje in dokazovanje kaznivih dejanj nalaga policiji, tožilstvu, preiskovalnemu sodniku, redarstvu ter Inšpektoratu za okolje in prostor. Policija pri svojem delu odkriva, preiskuje ter evidentira kazniva dejanja zoper okolje, prostor in naravne dobrine. Vsako leto slovenska policija objavi uradno statistiko evidentiranih kaznivih dejanj zoper okolje, prostor in naravne dobrine v kateri so zajete vse značilnosti tovrstnih kaznivih dejanj. Pregled uradne statistike policije za obdobje 20 let, med letoma 2001 in 2020, je pokazal da se trend evidentiranih kaznivih dejanj zoper okolje, prostor in naravne dobrine v Sloveniji povečuje, saj vsako leto evidentira vedno več tovrstnih kaznivih dejanj.

Overview of the crime against the environment, property and natural goods |
Secondary abstract: |
Pollution and degradation of the environment present one of the main problems of contemporary society, since they harm both human health and humankind as a whole. This is why actions of this sort are prohibited by law. When considering environmental polluting and degrading behaviour, one begins to talk of environmental crime, which encompasses any act of endangering and destroying the environment and is as such sanctioned by criminal law. The specifics of this sort of criminality lie in the complex and long-term nature of investigations into the aforementioned acts and being globally one of the fastest developing and most intricate types of crime. The field of environmental criminality is an object of interest and research for diverse scientific disciplines, as its understanding requires maintaining a multidisciplinary, interdisciplinary and transdisciplinary view. Environmental crime is the specific object of research of green criminology, social science that studies the endangerment of the environment, environmental-protection laws and measures. The environment is best protected through holistically oriented protection measures, among which the legal protection of the environment plays a significant role. The legal protection of the environment in Slovenia is ensured mainly by the Penal code, which encompasses punishable actions against the environment, property and natural goods punishable by law. Slovenian law entrusts the Police, Inspectorate for the environment and spatial planning, public prosecutors, examining magistrates, municipal police and local police with discovering, investigating and prosecuting polluting and degrading acts. Every year, the Slovenian Police publishes official statistics of identified punishable acts against the environment, property and natural goods. The published data includes all different characteristics of punishable acts of the said kind. An overview of the official statistics for the past 20 years, covering 2001 to 2020 has shown a rising trend in said punishable acts, their number increasing every year. |
