Povzetek

Voda je naravna dobrina in predstavlja temeljni pogoj za življenje na Zemlji. Čeprav je naš planet v veliki večini sestavljen iz vode, se moramo zavedati, da nam vsa ta voda ali ni dostopna ali pa ni primerna za uporabo. Slovenija sicer velja za državo, ki je bogata z vodo in vodnimi viri, vendar pa marsikje drugje po svetu temu ni tako in ljudje se srečujejo tako s pomanjkanjem neoporečne pitne vode kot tudi s pomanjkanjem vode, potrebne za osnovne sanitarije. Zaradi tega je varovanje vode in vodnih virov izrednega pomena. Kriminaliteta zoper vode spada med oblike kriminalitete, katere se ljudje najmanj zavedamo. Ker se posledice odražajo na drugačen način kot pri klasični kriminaliteti, pogosto o njej niti ne razmišljamo. Vendar pa postaja vse bolj pereč problem današnjega časa. V magistrskem delu nas je zanimalo, kakšna je pravna ureditev kriminalitete zoper vode in v kolikšni meri je prisotna v Sloveniji. Ugotovili smo, da je pravna ureditev dokaj obsežna, kar povzroča probleme predvsem inšpektorjem Inšpektorata Republike Slovenije za okolje in prostor. Le-ti se ukvarjajo z nadzorom in s pregledi; zakonodaje glede na število zaposlenih ne uspejo dohajati. Pri pregledu podatkov policije o ovadbah za kazniva dejanja smo ugotovili, da je kriminalitete zoper vode in v povezavi z njo izredno malo. Vendar pa dvomimo, da so vsa ravnanja oziroma dejanja ustrezno prijavljena, obravnavana in preganjana. Zanimalo nas je tudi stališče prebivalcev Republike Slovenije do kriminalitete zoper vode. Glede na dobljene rezultate smo ugotovili, da se s tovrstno kriminaliteto anketiranci sicer ne srečujejo vsakodnevno. Kljub temu pa kriminaliteto zoper vode najbolj poznajo v najstarejši starostni skupini (55 let in več), in sicer v največjem deležu v jugovzhodni Sloveniji, posavski ter podravski regiji. Prav tako je po njihovem mnenju manj nevarna od ekološke kriminalitete, glavnega storilca pa jim predstavlja industrija.

Sekundarni povzetek: Water is a natural resource and a prerequisite for life on Earth. Although the surface of our planet is mostly composed of water, it is important to realize that most of this water is either not available or not suitable for consumption. Slovenia is considered a country rich in water resources, but in many other places around the world the situation is very different, and people are faced with the lack of safe drinking water and even the lack of water needed for basic sanitation. For this reason, the conservation of water and water resources is of the utmost importance. Crime against water is a form of crime that people are least aware of. As its consequences are not as immediately obvious as in the case of traditional crime, we often do not even think of it. However, it is becoming an increasingly pressing problem in today's world. The master's thesis explores the regulation of water crimes and to what extent it is present in Slovenia. We found that the regulations are quite extensive, which poses certain problems for the inspectors of the Inspectorate of the Republic of Slovenia for the Environment and Spatial Planning. They are engaged in the relevant supervision and inspections, and due to the limited number of employees, the implementation of the legislation has proved challenging. The Police data on criminal offense charges shows very little crimes against water and associated crimes. It is open to doubt whether all the relevant punishable acts and behavior are duly reported, handled, and prosecuted. We also analyzed the attitude of Slovenian citizens towards water crimes. The findings revealed that the respondents do not regularly encounter such crime in their everyday life. The oldest age group (55 years old and over) proved most familiar with crimes against water, especially in South-Eastern Slovenia, the Posavje and Podravje Regions. In the respondent’s opinion, water crimes seem less dangerous than environmental crime; and industrial production was named the main perpetrator.
