Abstract
V zaključnem delu smo s področja kazensko procesnega prava natančneje preučili institut kazenske ovadbe in prve zaznave kaznivega dejanja oziroma notitia criminis. Naredili smo pregled zakonske ureditve in povedali, katere vrste kazenskih ovadb poznamo ter kakšne so dolžnosti podajanja le-teh. Za lažje razumevanje kako stvari potekajo v praksi, pa smo preučili tudi pet sodnih judikatov, ki natančneje opredeljujejo sodno prakso glede podajanja kazenskih ovadb.
V sklopu kazenske ovadbe in notitia criminis smo del pozornosti namenili tudi predkazenskemu postopku in problematikam, s katerimi se srečujemo, ko poskušamo definirati začetek le-tega. Kratek pregled literature nam pokaže, da si avtorji v svojih definicijah začetka predkazenskega postopka nasprotujejo, Zakon o kazenskem postopku pa ne razčisti ničesar, saj je tudi v svojih definicijah kazenske ovadbe pomanjkljiv. Poznamo par fragmentih določb, ki urejajo kazensko ovadbo, vendar o prvi zaznavi kaznivega dejanja ne najdemo ničesar.
Predkazenski postopek s svojo dejavnostjo izvajajo policija, državni tožilec in preiskovalni sodnik. Ti trije glavni subjekti z zakonsko določenimi pooblastili tekom predkazenskega postopka lahko temeljito posegajo v temeljne človekove pravice in svoboščine. Policija je državni organ preiskovanja in odkrivanja kaznivih dejanj, ki najpogosteje prejme kazensko ovadbo. Načeloma so jo dolžni takoj posredovati državnemu tožilcu, ki kot organ pregona oziroma dominus litis nadzoruje in usmerja delovanje policije.
Preverili pa smo tudi, kako je področje prve informacije o zaznavi kaznivega dejanja urejeno v Nemčiji in na Hrvaškem.

In the bachelor’s thesis, in the field of criminal procedure law, we examined in more detail the institute of criminal complaint and the first information of a criminal offense or notitia criminis. We made an overview of the legal regulation and told what types of criminal charges we know and what are the obligations of declaring them. To make it easier to understand how things work in practice, we have also examined five court cases that will more precisely define the case –law regarding the issuing of criminal charges.
As part of the criminal complaint and notitiae criminis, we also paid some attention to the pre-criminal procedure and the problems we encounter when trying to define the beginning of it. A brief review of the literature shows that the authors contradict each other in their definitions of the beginning of pre-trial proceedings, but the Criminal Procedure Act does not clarify anything, as it is also deficient in their definitions of criminal proceedings. We know a couple of fragments of the provisions governing a criminal complaint, but we find nothing about the first detection of a crime.
The pre-trial proceedings are carried out by the police, the public prosecutor and the investigating judge. These three main entities, with statutory powers, can thoroughly interfere with fundamental human rights and freedoms during pre-trial proceedings. The police are the state body investigating and detecting crimes, which most often receives a criminal complaint. They are usually obliged to immediately forward it to the state prosecutor, who, as a law enforcement authority or dominus litis, supervises and directs the operation of the police.
We also checked the regulation on the first information on the perception of a crime in Germany and Croatia. |
