Povzetek
Kazenski postopek v Sloveniji je razdeljen na dva dela, predhodni in kazenski postopek, pri čemer se predhodni postopek še naprej deli na dve fazi in sicer na neformalni predkazenski postopek in formalno sodno preiskavo. Trije glavni subjekti predkazenskega postopka so policija, državni tožilec in preiskovalni sodnik. Policija v vlogi organa odkrivanja pridobiva informacije, ki služijo kot podlaga za odločitev državnega tožilca o tem, ali bo uvedel kazenski pregon ali ne. Državni tožilec ima vlogo organa pregona in kot dominus litis predkazenskega postopka nadzoruje celoten postopek in skrbi za njegovo delovanje. Predkazenski sodnik ima v tem delu postopka dvojno vlogo in sicer opravlja preiskovalno in garantno funkcijo, ki pa si med seboj nasprotujeta. Predkazenski postopek v osnovi opredeljuje Zakon o kazenskem postopku, njegovi posamezni deli pa so porazdeljeni tudi po drugih zakonskih in podzakonskih aktih, pri čemer noben ne ponuja njegove zaokrožene opredelitve. Skozi zgodovino je predkazenski postopek doživel kar nekaj sprememb, ki so vanj vnesle številna nasprotja in danes onemogočajo njegovo učinkovitost. V ureditvi predkazenskega postopka tako najdemo številne pomanjkljivosti, pri čemer se največje kažejo v formalnih in neformalnih policijskih pooblastilih, medsebojnih razmerjih treh glavnih subjektov, neracionalni porazdelitvi postopka in pomanjkljivi opredelitvi celotnega predkazenskega postopka. V diplomski nalogi smo pregledali in se kritično opredelili do današnjega predkazenskega postopka ter izpostavili njegove najbolj kritične točke. Skušali smo tudi odpraviti njegove pomanjkljivosti in prikazati predkazenski postopek v prihodnosti.

Pre-Trial criminal procedure in the present and in the future |

Slovenian criminal procedure is divided into two parts, the preliminary and criminal procedure. The preliminary procedure is furthermore divided into two phases, the informal pre-trial criminal procedure and formal investigation phase. Three key actors in the pre-trial criminal procedure are the police, the public prosecutor and the examining judge. The police represents the body responsible for detecting the criminal activities and is in charge of providing the information that the public prosecutor needs for his decision, whether to initiate the prosecution or not. The public prosecutor represents the body of prosecution, who, as dominus litis of the pre-trial criminal procedure, supervises and guides the procedure. The examining judge`s role nowadays is ambiguous, because he has an investigative and judicial task, which are incompatible. The pre-trial criminal procedure is largely defined in the Criminal Procedure Act, however some of its parts are described in other statutory acts, none of which offer a complete definition. Throughout the history, pre-trial criminal procedure endured a lot of changes, which brought many contrasts to the procedure and are blocking its efficiency. We can find many drawbacks in the regulation of today`s procedure, wherein the biggest ones appear to be formal and informal police authorisations, relations between the three key actors, irrationally divided procedure and insufficient regulation of the entire pre-trial criminal procedure. In the thesis we examined and critically reviewed today`s pre-trial criminal procedure and exposed its most critical spots. We tried to eliminate its drawbacks and show the regulation of the pre-trial criminal procedure in the future. |
