Preiskovanje tihotapljenja ljudi

Abstract

Magistrsko delo obravnava preiskovanje tihotapljenja ljudi s kriminalističnega vidika. V teoretičnem delu magistrskega dela je opredeljen termin organizirane kriminalitete, razlike in povezanost med tihotapljenjem ljudi ter trgovino z ljudmi, pravna ureditev tihotapljenja ljudi v Sloveniji, našteti so ključni kriminalistični ukrepi predkazenskega postopka preiskovanja teh specifičnih kaznivih dejanj, t.i. klasični kriminalističnimi ukrepi in prikriti preiskovalni ukrepi, pomen mednarodnega sodelovanja in sodelovanja policije s tožilstvom. V nadaljevanju magistrskega dela je predstavljen empirični del, ki temelji na raziskavi, le-to pa smo opravili s pomočjo spletne ankete, ki je bila posredovana kriminalistom na državnem in regionalnem nivoju, ki se ukvarjajo s preiskovanjem kaznivih dejanj tihotapljenja ljudi. Z raziskavo smo ugotovili, da med kriminalisti zaposlenimi na državnem in regionalnem nivoju, glede mnenja o pomembnosti dejavnikov klasičnih kriminalističnih ukrepov, kot ukrepov za uspešno preiskovanje kaznivih dejanj tihotapljenja ljudi, v populaciji ni razlik. Ugotovili smo tudi, da med formalno stopnjo izobrazbe kriminalistov in njihovo oceno dejavnika sodelovanja s tožilstvom na podlagi uredbe, ki po mnenju kriminalistov vpliva ali tudi ne vpliva na uspešnost preiskovanja tihotapljenja ljudi, ne obstaja povezanost v populaciji. Potrdili pa smo, da da med kriminalisti zaposlenimi v policiji manj kot 20 let in več kot 20 let, glede mnenja o pomembnosti dejavnika prikritega preiskovalnega ukrepa tajnega opazovanja, kot ukrepa za uspešno preiskovanje kaznivih dejanj tihotapljenja ljudi, v populaciji ni razlike.

Secondary abstract:	The master's thesis deals with the investigation of human smuggling from a criminal point of view. The theoretical part of the master's thesis defines the term organized crime, differences and connection between human smuggling and human trafficking, legal regulation of human smuggling in the Republic of Slovenia, lists the key criminal measures of the pre-trial investigation of these specific crimes, i.e., classic criminal measures and covert investigative measures, the importance of international and police cooperation with the prosecution. In the continuation of the master's thesis, an empirical part based on research is presented, which we conducted with the help of an online survey, which was provided to criminals at the national and regional level, who are involved in investigating human trafficking. The research found that there are no differences in the population between criminal investigators employed at the national and regional level in terms of the opinion on the importance of the factors of classic criminal measures as measures for successful investigation of human trafficking offences. We also found that there is no correlation in the population between the formal level of education of criminal investigators and their assessment of the factor of cooperation with the prosecutor's office under a regulation which, according to criminal investigators, affects or does not affect the success of human trafficking investigations. However, we confirmed that there is no difference in population between criminals employed in the police for less than 20 years and more than 20 years, in terms of opinion on the importance of the covert investigative measure of covert surveillance as a measure for successful investigation of human trafficking offences.
