Abstract

V zadnjih letih je Republika Slovenija pod povečanim migracijskim pritiskom, kar se odraža tudi v povečanju števila prošenj za mednarodno zaščito. Mednarodno zaščito države članice nudijo tistim posameznikom, ki te zaščite ne morejo dobiti v svoji državi. Posameznik, ki želi pridobiti mednarodno zaščito, mora zanjo zaprositi pri pristojnem državnem organu in z njim med celotnim upravnim postopkom sodelovati. Najpomembnejši vir informacij, ki jih pristojni organ potrebuje za odločanje v postopku, je v večini primerov izjava prosilca za mednarodno zaščito, ki jo uradne osebe pridobijo preko razgovorov s prosilci. Glede na to, da pozitivno rešena prošnja za mednarodno zaščito pomeni poleg možnosti legalnega bivanja v Republiki Sloveniji tudi ostale ugodnosti, npr. dostop do trga dela in socialne pomoči, so prosilci, ki vedo, da do mednarodne zaščite morda niso upravičeni, pripravljeni na razgovorih tudi zavajati uradne osebe. V zaključnem delu smo osvetlili pomen ocene verodostojnosti prosilcev za kakovostno in objektivno odločanje v postopkih pridobitve mednarodne zaščite in pravno podlago, ki jo imajo uradne osebe za takšno oceno. Prikazane so nekatere pasti, ki se pri takem ocenjevanju pokažejo zaradi kompleksnosti celotnega postopka in morebitne subjektivnosti odločevalcev ter izzivov, ki se odpirajo pri preverjanju konkretnih dokazov, ki jih podajo prosilci za mednarodno zaščito. V zaključnem delu so opisana tudi določena orodja, ki jih imajo migracijski organi na voljo za preverjanje verodostojnosti prosilcev ter njihov pomen za celoten postopek mednarodne zaščite.

Secondary title: Credibility of applicants for international protection
Secondary abstract: In past years Republic of Slovenia has witnessed high migration pressure what has also been reflected in increasing number of applications for international protection. International protection is offered to the individuals that cannot get this type of protection in their countries of origin. Individuals wishing to obtain international protection must request for it at the competent national authority and have to fully cooperate with the authority during all the procedure. The most important source of information for deciding in the procedure is interview for international protection. Considering that a positively resolved application for international protection means the possibility of legal residence in the Republic of Slovenia and other benefits, like access to the labor market and social assistance, encourages applicants to mislead public officials when they conduct interviews. Essay describes importance of credibility assessment for quality and objective decision-making process in the field of international protection and legislative basis for such assessment. Due to complexity of asylum determination procedure, subjectivity od decision makers and challenges that testing of factual evidence brings there are some traps that arise at such assessment. At the end of thesis different tools that are in use by migration offices to assess credibility of asylum seekers and for decisions in international protection procedure are described.
